Board of Zoning Adjustments Regular Meeting December 6, 2007 <br />Minute No. 2007-23 Page 2 of 16 <br />The other Board Members had also received Federal Express packages from Mr. <br />MacDonald. <br />IItem 5: Work Session <br />None <br />Item 6: Public Hearing <br />(a) Matter of PLN2007-00013; Conditional Use Permit; to establish a ministry <br />and associated activities, defined by the Zoning Code as an Assembly Use. The <br />proposed facility is not a permitted or conditionally permitted use in the IP <br />Industrial Park District; 14600 and 14850 Catalina Street; Assessor's Parcel <br />Numbers 80G-933-20, 21 and 22-1; Faith Fellowship Worship Center, a.k.a. <br />International Church foursquare Gospel (applicant and property owner); IP <br />Industrial Park. [Kathleen Livermore] <br />Interim Planning Manager Livermore stated the church planned to use a vacant, <br />46,080 square -foot, industrial building located on the site for their ministry. The site was <br />comprised of three separate parcels and totaled 3.55 acres. The surrounding <br />neighborhood was primarily industrial with residences approximately 600 feet to the <br />west. There were three scheduled Sunday services and additional activities included <br />weekly food fellowship and bible study sessions for approximately 400 attendees; weekly <br />bible study meetings for women, intermediate, high school and college students; weekly <br />singles group; weekly choir rehearsals. Childcare was available for attendees. The <br />primary proposed use met the City of San Leandro Zoning Code definition of "Assembly <br />Use," which was not permitted or conditionally permitted in the IP District. <br />In May 2006, the city received an application from the applicant that requested a zoning <br />code amendment to conditionally permit assembly uses in the Industrial Limited Zone <br />and the rezoning of property at the above addresses from IP to IL. At the time the <br />property was purchased in January 2007, assembly uses were not allowed in the IP Zone <br />or any other industrial or commercial zone in the City. On March 19, 2007 the City <br />Council approved zoning code and map amendments that established an Assembly Use <br />Overlay, which would allow assembly uses with approval of a Conditional Use Permit. <br />The proposed project site was not a part of the 196 parcels in the Overlay. The Overlay <br />became effective on May 1, 2007. On April 12th the applicant's rezoning application was <br />heard by the Planning Commission and it was denied. It was appealed to City Council, <br />who heard it on May 7, 2007 and it was also denied. <br />The proposed use would generate 1,688 average daily trips (ADT) on Sundays compared <br />to 31 ADTs for an industrial use. During weekdays, ADTs generated by the applicant <br />would be 419 compared to 321 vehicles for an industrial use. This matter would be <br />statutorily exempt from CEQA review only if it were denied by the BZA. If the Board <br />chose to disagree with staff's recommendation, additional environmental impact analysis <br />would be required. She introduced Debbie Pollart, former Planning Manager, who had <br />been involved with some of the actions taken in the past, and Reh-Lin Chen, Senior <br />Transportation Engineer, who was available to answer traffic questions. <br />
