Board of Zoning Adjustments Regular Meeting December 6, 2007 <br />Minute No. 2007-23 Page 3 of 16 <br />Member Daly asked to hear the definition of an assembly use and he asked if it was <br />based upon a uniform zoning code. Did other cities have similar language in their zoning <br />codes? <br />Interim Planning Manager Livermore read, "Meeting, recreational, social facilities of <br />a private or nonprofit organization, primarily for use by members or guests or facilities <br />for religious worship or incidental religious education (but not including schools as <br />defined in this section). This classification includes union halls, social clubs, fraternal <br />organizations and youth centers." This was the City's specific Zoning Code. Other cities <br />might have similar language in their zoning codes. <br />Member Gilcrest asked if any other CUPs had been granted for assembly use within the <br />IP District, since allegations had been made of disparate application. <br />Interim Planning Manager Livermore was not aware of any CUPS for assembly use <br />with the IP District. She referred the question to Former Planning Manager Pollart. <br />Former Planning Manager Pollart added that she was not aware of any assembly use <br />CUPs since the year 2000, when she joined the City staff. <br />Member Gilcrest asked if the recommended denial was consistent to every other <br />application for assembly use within this district. <br />Interim Planning Manager Livermore stated that it was. <br />Member Marr asked the reason that this parcel was not included in the Assembly <br />Overlay District. <br />Interim Planning Manager Livermore replied that this parcel did not meet the criteria <br />for the Overlay. <br />Member Shields asked if any of the neighbors had complained of this potential use on <br />Catalina Street. <br />Interim Planning Manager Livermore was not aware of comments made by some <br />homeowner associations, but Former Planning Manager Pollart could probably answer <br />his question. <br />Former Planning Manager Pollart understood that the applicant had contacted several <br />of the surrounding property owners, who had responded favorably. <br />Member Shields asked if the City knew of another location that would be suitable for <br />this applicant's use. <br />Interim Planning Manager Livermore replied that this application involved only the <br />property located within this Industrial Park District. <br />Jeff McGallian, 13985 Tahiti Road, stated that he was a former member of the BZA.
