shall be subject to the review and approval of the Community Development <br />Director, Alameda County Fire Marshall and the City Engineer. <br />IL PERMITTED USE <br />A. This approval is for a Variance, Parking Exception, and Site Plan Review. The <br />Variance permits construction of the building to a maximum height of 65 feet, <br />where the maximum allowable height is 50 feet in the industrial districts. The <br />Parking Exception permits a total of 108 standard passenger vehicle parking <br />spaces where the total required is 156 parking spaces. The Site Plan Review is a <br />design review approval to construct a new 205,000 square foot storage facility <br />with loading docks as outlined in Exhibit A, and administrative offices for a <br />frozen goods storage company; 400 Hudson Lane; Alameda County Assessor's <br />Parcel Numbers 75-87-1-2 and 75-87-8. <br />B. No application for amendment of the application or Conditions of Approval may <br />be submitted or accepted for processing by the city unless (i) there is full <br />compliance with all terms of the application and Conditions of Approval; or (ii) <br />the Community Development Director can waive compliance with the terms of the <br />application if they are minor in content. <br />C. Construction of the project shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the project design, materials or colors <br />shall be subject to the review and approval of the Community Development <br />Director who may administratively approve minor changes, or for more <br />substantial changes, require review by the Board of Zoning Adjustments as a <br />modification to the Variance, Parking Exception, and/or Site Plan Review. <br />D. Unless otherwise specified on the approved plans (Exhibits A - M) or in these <br />Conditions of Approval, the development shall comply with the applicable zoning <br />standards for the IG -General Industrial Zoning District, such as but not limited <br />to standards governing setbacks, building coverage, outdoor storage, screening, <br />trash enclosures, and landscaping, with the exception of the variance granted to <br />exceed the height limit and with the exception to provide a reduced number of <br />parking spaces than required by the floor area of the uses within the building. <br />III. ADDITIONAL PLAN SUBMITTALS <br />A. Prior to issuance of a building permit, the Developer shall submit final landscape <br />and irrigation plans for the review and approval of the Community Development <br />Director. For specific verbiage see condition IX. LANDSCAPING. <br />B. Prior to issuance of a building permit, the Developer shall submit final plans and <br />details for all the off-site soundwall in the public right-of--way on the east side of <br />San Leandro Boulevard and returning east along the north side of Hudson Lane, <br />terminating at the point intersecting with the Cherry Street right-of--way, for the <br />review and approval of the Community Development Director.
