1.0 <br />2.0 <br />PROJECT DESCRIPTION <br />The City of San Leandro has previously contracted with Group 4 Architecture, Inc. for <br />preparation of construction documents for a new Senior Community Center and <br />associated improvements at 13909 East 14~' Street. The City of San Leandro awarded a <br />construction contract to perform the work described in these contract documents in July, <br />2008. Construction is anticipated to start in October 2008. This contract is for <br />construction assistance on the project as described below. <br />BASIC SERVICES FOR CONTRACT ADMINISTRATION & PROJECT <br />CLOSEOUT SERVICES <br />Construction Administration Services (excluding Project Closeout) shall terminate 300 <br />working days from the start date established in the Notice to Proceed (NTP) of the <br />Contract for Construction or on the date of Substantial Completion, as determined by <br />mutual agreement of the City and Consultant, whichever is earlier. If the Contractor has <br />not achieved Substantial Completion within this timeframe, the Consultant shall be <br />entitled to Additional Services for work performed (which would not have otherwise <br />been required were the contractor to have complied with the original project schedule) <br />between the termination Basic Services, as described above, and the mutually agreed date <br />of Substantial Completion. Once Substantial Completion has been achieved, Basic <br />Services for the Project Closeout portion of work will commence. See Section 2.5 <br />Below. <br />a) Substantial Completion is defined as the date on which the project is sufficiently <br />complete that it can be used for the purpose for which it is intended. <br />2. The Consultant shall advise and consult with the City during the provision of the Contract <br />Administration Services. The Consultant shall have authority to act on behalf of the City <br />only to the extent provided in this Agreement unless otherwise modified by written <br />amendment. <br />3. Duties, responsibilities and limitations of authority of the Consultant under this phase <br />shall not be restricted, modified or extended without written agreement of the City. <br />4. The Consultant shall neither have control over or charge of, nor be responsible for, the <br />construction means, methods, techniques, sequences or procedures, or for safety <br />precautions and programs in connection with the Work, since these are solely the <br />Contractor's rights and responsibilities under the Contract Documents. <br />5. The Consultant shall not be responsible for acts or omissions of the Contractor, <br />Subcontractors, or their agents or employees, or of any other persons or entities <br />performing portions of the Work. <br />CSA between City of San Leandro and Group 4 Architecture Project No. 06-210-18-116 <br />San Leandro Senior Center -Phase 2 Exhibit A Page 16 <br />
