Hollister Interim City Manager RESOLUTION DECLARING RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON TUESDAY, NOVEMBER 4, 2008 SUMMARY AND RECOMMENDATION A resolution declaring the results of the November 4, 2008 Special Municipal Election for the City of San Leandro is presented to the City Council for consideration and approval. Attached to the resolution is the Certificate of Election Results prepared by the Alameda County Registrar of Voters (ROV). The Certificate lists the final tally of votes received by each candidate and ballot measure as determined by the Official Canvass performed by the Registrar of Voters of the returns of all votes cast in the City of San Leandro. The City Council is requested to adopt the attached resolution declaring the results of the election. By the Council's declaration of the election results, the ordinances amending the Utility Users' Tax and establishing the 911 Tax, approved by the voters on November 4, 2008, are adopted. BACKGROUND The Charter of the City of San Leandro requires a successful candidate for elective office to receive at least 50% plus one of the votes cast for that office. In the event that no candidate receives 50% plus one of the votes cast for that office, the Charter requires the City Council to provide for a runoff vote to determine the person elected. In the June 3, 2008 General Municipal Election, no candidate for City Council District 2 received the required 50% plus one votes cast for those offices to win the election. On July 7, 2008, the City Council adopted Resolution No. 2008-077, calling a Special Municipal Runoff Election, to be held on November 4, 2008, among the two persons-Linda Perry and Ursula Reed-receiving the highest number of votes for the office of City Councilmember, District 2, in the June 3, 2008 General Municipal Election. On July 28, 2008, the City Council, by adoption of Resolutions 2008-097, 2008-098 and 2008-099, added three measures (Measures RR, SS and TT, respectively) to the November ballot.
