Hollister <br />Interim City Manager <br />RESOLUTION DECLARING RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD <br />ON TUESDAY, NOVEMBER 4, 2008 <br />SUMMARY AND RECOMMENDATION <br />A resolution declaring the results of the November 4, 2008 Special Municipal Election for the <br />City of San Leandro is presented to the City Council for consideration and approval. Attached to <br />the resolution is the Certificate of Election Results prepared by the Alameda County Registrar of <br />Voters (ROV). The Certificate lists the final tally of votes received by each candidate and ballot <br />measure as determined by the Official Canvass performed by the Registrar of Voters of the <br />returns of all votes cast in the City of San Leandro. <br />The City Council is requested to adopt the attached resolution declaring the results of the <br />election. By the Council's declaration of the election results, the ordinances amending the <br />Utility Users' Tax and establishing the 911 Tax, approved by the voters on November 4, 2008, <br />are adopted. <br />BACKGROUND <br />The Charter of the City of San Leandro requires a successful candidate for elective office to <br />receive at least 50% plus one of the votes cast for that office. In the event that no candidate <br />receives 50% plus one of the votes cast for that office, the Charter requires the City Council to <br />provide for a runoff vote to determine the person elected. In the June 3, 2008 General Municipal <br />Election, no candidate for City Council District 2 received the required 50% plus one votes cast <br />for those offices to win the election. <br />On July 7, 2008, the City Council adopted Resolution No. 2008-077, calling a Special Municipal <br />Runoff Election, to be held on November 4, 2008, among the two persons-Linda Perry and <br />Ursula Reed-receiving the highest number of votes for the office of City Councilmember, <br />District 2, in the June 3, 2008 General Municipal Election. On July 28, 2008, the City Council, <br />by adoption of Resolutions 2008-097, 2008-098 and 2008-099, added three measures (Measures <br />RR, SS and TT, respectively) to the November ballot. <br />
