IY. MAINTENANCE <br />A. The site shall be well maintained and shall be kept free of litter, debris and weeds. <br />B. Trash and recycling shall be kept within appropriate receptacles and the <br />receptacles kept within the trash enclosure at all times. The trash enclosure on the <br />site shall be used and maintained at all times. Garbage and recycling pick up by <br />the disposal company shall be maintained at a capacity to prevent the bins from <br />overflowing at any time. <br />C. The signage shall be kept in a good, clean, sound condition at all times; any <br />damage to the signs shall be promptly repaired. <br />D. Any graffiti shall be removed from the building walls and the perimeter fencing. <br />E. The applicant shall be responsible for prompt pick-up of any litter or debris <br />attributable to the market. Pick-up shall be for a distance of 200 feet from the <br />exterior property lines. <br />IV. FENCING AND SCREENING REQUIREMENTS <br />A. The new stained chain link fencing proposed along the side and rear of the <br />building shall not exceed seven (7) feet in height with top and bottom framed <br />chain link fence and shall be maintained in good condition at all times. <br />B. Any new roof top mechanical equipment for the building shall be screened from <br />view so as not to be visible from adjacent properties or streets, to the satisfaction <br />of the Zoning Enforcement Official. <br />C. Gates to the refuse area shall be closed except when necessary to move out the <br />dumpster or deposit trash from garbage receptacles. <br />D. No barbed wire or ribbon wire shall be installed on any wall, fence or building on <br />the property. <br />V. CONSTRUCTION PROVISIONS <br />A. Construction activity shall not commence prior to 7:00 a.m. and shall cease by <br />7:00 p.m. Monday through Friday, and construction activity shall not commence <br />prior to 8:00 a.m. and shall cease by 7:00 p.m. on Sunday and Saturday. No such <br />construction is permitted on Federal holidays. As provided in this City of San <br />Leandro's Noise Ordinance (ORDINANCE NO. 2003 - 005), "construction" <br />shall mean any site preparation, assembly, erection, substantial repair, alteration, <br />demolition or similar action, for or on any private property, public or private <br />right-of--way, streets, structures, utilities, facilities, or other similar property. <br />Construction activities carried on in violation of this Article may be enforced as <br />Agreement to Condirions December 18, 2008 <br />PLN2008-00047 Page 5 of 7 <br />
