The vote was 6-0, with Vice Mayor Stephens absent. The City and Agency
would then use the property for temporary replacement parking during the construction
of a City garage. At the close of escrow, all of the pending litigation would be
dismissed.

Mr. Hollister added that after the property is no longer needed for parking, the City
would seek to have the site developed pursuant to the Downtown Transit Oriented
Development Strategy.

Vice Mayor Stephens stated that, although he was unable to attend the closed session
due to a work commitment, he supports the action that was taken by the Council.
