Resolution No. 99-165, Resolution Approving Amendment No. 1 to Contractual <br />Services Agreement with Barry J. Miller, AICP, Relating to Preparing Additional <br />General Plan Elements Beyond Land Use and Circulation Elements and <br />Preparation of Associated Environmental Documentation (amends the contractual <br />services agreement that provides for additional services from a project team <br />headed by Barry J. Miller to prepare the Open Space conservation, Safety and <br />Noise Elements of the General Plan in addition to the Land Use and Circulation <br />Elements and Preparation of Associated Environmental Documentation; budgeted <br />for 1999-2000). Cost: $100,000 (budgeted for 1999-2000) (2323) <br />E. Resolution Approving Final Subdivision Map, Subdivision Improvement <br />Agreement (Public Improvements), Subdivision Improvement Agreement (Private <br />Improvements), and Acceptance of Dedication of Public Utility Easement and <br />Public Right-of--Way for Tract 7093; Medallion, Phase I, Adjacent to 701 Fremont <br />Avenue; Developer: Ryland Homes of California, Inc. (provides for the <br />development of twenty-three [23], single-family dwellings on a 2.2-acre vacant lot <br />adjacent to 701 Fremont Avenue). Removed from the Consent Calendar to <br />New Business. <br />7. NEW BUSINESS <br />Items Removed from the Consent Calendar: <br />6.E Resolution Approving Final Subdivision Map, Subdivision Improvement Agreement <br />(Public Improvements), Subdivision Improvement Agreement (Private Improvements), <br />and Acceptance of Dedication of Public Utility Easement and Public Right-of--Way for <br />Tract 7093; Medallion, Phase I, Adjacent to 701 Fremont Avenue; Developer: Ryland <br />Homes of California, Inc. (provides for the development of twenty-three [23], single- <br />family dwellings on a 2.2-acre vacant lot adjacent to 701 Fremont Avenue). <br />M/5/C to approve Item 6.E: Ayes: Grant, Loeffler, and Young (3); Noes: Lothrop <br />and Glaze (2) <br />The City Attorney noted that, given the vote of 3-2, the matter would not be carried, <br />as four (4) affirmative votes are required to carry a Motion. He further noted that, if <br />this item is deferred to the next City Council Meeting, it will be deemed approved by <br />operational law. He explained that a Final Map is a "ministerial act;" and, if it is not <br />approved within the first, regularly agendized meeting, it is deemed approved by <br />operation of law. <br />The City Attorney explained it would be better for the City Council to vote <br />affirmatively to approve the Tentative Map or to vote negatively on it. <br />
