Minutes - City of San Leandro City Council and Page - 7 - <br />San Leandro Redevelopment Agency Meeting - January 20, 1998 <br />C. Minute Order No. 98-6, Matter of Appointment of Representative to the <br />Alameda County Mosquito Abatement District Board of Trustees. <br />(1156/1424) <br />The City Council appointed Council Member Lothrop to the Alameda County <br />Mosquito Abatement District Board of Trustees for the two-year term, <br />January 2, 1998 through January 1, 2000. <br />M/S/C Young and Polvorosa. Ayes: 7; Noes: o <br />D. Resolution Approving a Joint Powers Agreement with Participating Bay <br />Area Cities for a Saturday Night Special Legal Defense Fund (provides <br />for a legal defense fund to defend against potential lawsuits as a <br />result of local ordinances banning Saturday Night Specials and $5,000 <br />from each of the participating cities -- Alameda, Berkeley, El Cerrito, <br />Emeryville, Oakland, Pinole, Pleasanton, Richmond, San Pablo, and San <br />Leandro). <br />Council Member Glaze questioned the use of pro bono attorneys, and <br />Council discussion ensued regarding their use rather than participating <br />in a Joint Powers Agreement (JPA). It was noted that, if pro bono <br />services were available, they could be used by the JPA as well. <br />Motion by Council Member Loeffler to carry the item over for 30 days, <br />seconded by Council Member Galvan for discussion only. <br />Council Member Galvan noted that, at previous hearings, attorneys had <br />testified that they would defend the City's Ordinance pro bono; and he <br />feels the money could be better used elsewhere. He will be voting "No" <br />on this item. <br />The issue of defending other cities' ordinances, as it relates to <br />setting a precedent, was also discussed, in addition to the cost-savings <br />potential. <br />Council direction was to carry this item over for 30 days to address the <br />issues stated, which included: Are the Ordinances similar? Are there <br />attorneys who would defend our Ordinance pro bono? How many cities are <br />participating and have acted on this JPA agreement? With regard to <br />ballot information, will the City of Oakland have a Junk Gun Ballot <br />Measure on the June ballot? <br />
