Minutes - City of San Leandro City Council and Page - 4 - <br />San Leandro Redevelopment Agency Meeting - April 20, 1998 <br />Suzanne 6uramino, San Leandro, on Behalf of the Alliance of Family and <br />Friends for Elderly and Teenagers, addressed the Council. She stated <br />her opposition to the proposed Ordinance and asked where the children- <br />oriented zone is. She feels this issue should be continued at least <br />until May 20 to facilitate further community outreach regarding the <br />issue. She also read a letter from Jayce Starosciak, Member of the San <br />Leandro Unified School District, Board of Trustees, in opposition to the <br />proposed Ordinance. <br />Mark Tichy, 2042 Marina Court, addressed the Council, stating it is a <br />violation of his constitutional rights to have to look at this type of <br />business. He asked how the license fee works and stated we should make <br />it economically unfeasible. He further asked how many of these <br />establishments the City would have to allow for the current population. <br />He feels that, if we have to allow these types of businesses, there <br />should be a "red-light" district created. He further stated no one has <br />addressed sign regulations and what will be done to curtail advertising <br />in the paper. He also asked if this would encourage massage parlors. <br />He feels the community has not been given ample time to give input on <br />this issue. He concluded by stating that three police officers should <br />be assigned per business of this type. <br />Pastor David Hagey, addressed the Council, stating he doesn't believe <br />the Ordinance is as strict as it should be. He noted the Alcoholic <br />Beverage Control Board allows 18 year olds to view nudity if they are <br />not being served alcohol. He feels hotels and motels should be <br />regulated as well. He added that the City should get a specialized <br />opinion from special lawyers who have fought to keep these types of <br />businesses out of their community. <br />Melvin Bun, West Avenue 133rd, addressed the Council, stating these <br />types of businesses will promote prostitution. He added that it will <br />not be safe for children where one of these businesses is located. <br />Catherine Encino, West Avenue 133rd, addressed the Council, asking how <br />these businesses will be monitored to prevent them from switching from <br />what appears to be one business to an adult-oriented business. She <br />questioned where the "1,000-foot distance" measurement came from and <br />added that these types of businesses will be detrimental to our <br />children. She also expressed concern with the amount of senior citizens <br />in the proposed locations as well. <br />Council discussion ensued regarding signage, license fees, and <br />information that is available from the National Law Center. The City <br />Attorney noted the moratorium on these types of businesses expires in <br />May. There have been no applications made and/or are pending regarding <br />this Ordinance. He said, if the Council wanted to postpone adopting an <br />Ordinance of this type and an application was received in the interim, <br />the Council could adopt an urgency Ordinance. <br />
