PLN200$-00030; Cornerstone at San Leandro Crossings <br />Mitigated Negative Declaration <br />March 20, 2009 <br />Plan and Downtown San Leandro TOD Strategy to reduce air quality impacts, as follows: <br />Mitigation Measure #13: The applicant shall implement measures set forth in the Traffic <br />Impact Analysis Technical Memorandum (as revised February 17, 2009) to improve arterial <br />traffic, including contributing towards mitigation costs through transportation development <br />impact fees or fair -share contributions regarding signalization of the intersection of San <br />Leandro Blvd. and Parrott Street and the 1-880 / Marina Blvd. interchange to offset <br />potential traffic/ circulation impacts that could lead to a deterioration of air quality. <br />Mitigation Measure #14: The applicant shall cooperate with the appropriate regional, state <br />and federal agencies to implement the regional Clean Air Plan and enforce air quality <br />standards in compliance with General Plan Policy 31.01. <br />Mitigation Measure # 15: The applicant shall provide residents with on-site bicycle storage <br />lockers to promote alternative, environmentally -friendly methods of transportation such as <br />bicycling to help improve air quality by reducing the necessity of driving and by providing <br />better provisions for bicyclists and pedestrians, in compliance with General Plan Policy 31.02. <br />Mitigation Measure #16: The applicant shall utilize construction and grading practices that <br />minimize airborne dust and particulate matter. <br />Mitigation Measure #17: The applicant shall implement landscaping and tree planting to <br />absorb carbon monoxide and other pollutants. <br />Implementation of Mitigation Measures #13 through #17 reduce potential air quality impacts <br />to a level of less than significant. <br />Biological Resources <br />Site I has been previously graded and disturbed and contains an at -grade asphalt parking lot with <br />mature, ornamental trees around its perimeter. Site 2 has been previously graded and disturbed <br />and is part of the site of the former Del Monte Processing Plant. Vegetation on that site is <br />limited to ruderal vegetation and some planted trees left over from the previous use. An <br />examination of the limited number of trees and shrubs on the site during the field investigation <br />did not reveal the presence of any nests of birds protected by the Migratory Bird Treaty Act. <br />However, any project activities that would result in the removal of existing woody vegetation <br />could potentially impact nesting birds (i.e., the loss of young birds or the abandonment of an <br />active nest), which would be a violation of Fish and Game Code Section 3503 and the federal <br />Migratory Bird Treaty Act and would be potentially significant impact. The mitigation measure <br />below would reduce potential impacts to nesting birds to a less -than -significant level. <br />Mitigation Measure #18: The applicant shall follow the tree preservation guidelines set <br />forth in the October, 2008 Hortscience Tree Report, including having the consulting <br />arborist review all project plans with regard to tree impacts and implementation of <br />necessary protection measures and avoiding grading, construction, demolition or other <br />work within designated, on-site Tree Protection Zones. <br />Mitigation Measure #19: The applicant shall conduct pre -construction surveys for the <br />presence of nesting birds within each of the project sites.
