PLN20084)0030; Cornerstone at San Leandro Crossings March 20, 2009 <br />Mitigated Negative Declaration <br />a qualified biologist to conduct a pre -construction breeding -season survey (approximately <br />February 1 through August 31) to determine if any birds are nesting on or directly <br />adjacent to the project area. The survey shall be conducted during the same calendar year <br />that construction is planned to begin. If no nesting birds are found, then no further action <br />would be required. If nesting birds are found within the trees or on or directly adjacent to <br />the project area, the project applicant shall avoid all bird nest sites located in the project <br />area during the breeding season (approximately February 1 through August 31), or until it <br />is determined by a qualified biologist that all young have fully fledged (left the nest). If the <br />construction cannot be delayed, avoidance shall include the establishment of a non- <br />disturbance buffer zone around the nest site. The size of the buffer zone will be determined <br />in consultation with the CDFG. The buffer zone shall be delineated by highly visible <br />temporary construction fencing, and shall remain in place until it is determined by a <br />qualified biologist that all young have fully fledged (left the nest). <br />Implementation of Mitigation Measures #18 and #19 reduce potential biology impacts to a <br />less than significant level. <br />Mineral Resources <br />The project area is classified by the California Geological Survey as MRZ-1 , a Mineral Resource <br />Zone for which there is adequate information to indicate that there are no aggregate mineral <br />resources present. Consequently, there would be no impact to mineral resources with project <br />implementation and no mitigation measures are required. <br />Hazards and Hazardous Materials <br />The Cornerstone at San Leandro Crossings site has the potential presence of chemicals of <br />potential concern (COPC) beneath the sites which could present unacceptable risks to <br />construction workers and future residents of the site. Iris Environmental (January 2009) has <br />developed a soil sample plan and a menu of mitigation measures to be utilized as necessary. <br />Additionally, a Phase I (Stantec, 2008) and Phase 11 (Iris Environmental, 2009) Site Assessment <br />has been prepared for the project to identify the potential for onsite or nearby soil or groundwater <br />contamination. <br />The mitigation measures include Subsurface Investigations, Pre -Development Mitigation <br />Measures, Risk Management Measures for Construction Phases, Pre -Construction Planning and <br />Notification, Site -Specific Health and Safety Worker Requirements, Construction Impact <br />Mitigation Measures, Site Control, Equipment Decontamination, Personal Protective Equipment, <br />Dust Control, Vertical and Horizontal Preferential Pathways, Storm Water Pollution Controls, <br />Excavation De -Watering, Additional Soil Management Protocols During Construction Activities, <br />Procedures of Unknown Areas of Contamination, and Imported Fill. <br />Mitigation Measure #20: The applicant shall utilize appropriate remediation efforts <br />identified in the Phase I and Phase II Environmental Assessments, including removal of <br />impacted soils and recompaction. <br />I <br />
