Vesting Tentative PLN2008-00030 7 July 20, 2009 <br />Policy 3.10 <br />CONVERSION OF NON-RESIDENTIAL LAND TO HOUSING AND PUBLIC USES <br />Encourage the development of new housing on underutilized commercial and industrial sites which meet <br />the following criteria: <br />• Sites on the edges of commercial or industrial areas, adjacent to established residential areas. <br />• Sites where continued use with commercial or industrial activities could perpetuate existing land <br />use conflicts. <br />• Sites with adequate infrastructure, access, and road capacity. <br />• Sites which are not constrained by external environmental factors, including freeway, railroad, <br />and airport noise. <br />• Sites where conflicts with surrounding uses would not be created in the event of re -use. <br />• Sites which lack `prime" qualities for commercial or industrial development, such as direct <br />freeway or rail access. <br />• Publicly -owned land which is not being used to its fullest potential. <br />Sites meeting the above criteria should also be considered for churches, libraries, parks, community <br />facilities, and other uses that provide necessary services and advance the quality of life in the <br />community. <br />FINDING: The proposed project is on the site of the existing BART parking lot and is located near the <br />San Leandro BART station in an area that is transitional from commercial uses to residential uses. The <br />site is surrounding by public streets and is supported by an existing water, drainage and sewer system. <br />Permits and/or Variances Granted <br />Site Plan Review Permit 2008-00030 was unanimously approved by the Planning Commission <br />on July 9, 2009. <br />Environmental Review <br />The proposed project tiers off of an Environmental Impact Report prepared for the Downtown San <br />Leandro Transit -Oriented Development (TOD) Strategy that was certified in September 2007. This <br />project involves a Vesting Tentative Map and Site Plan Review (PLN2008-00030) for a proposed <br />200 unit multi -family residential condominium project consisting of four stories of studios, one - <br />and two- bedroorn units over a ground floor and basement containing a 290 -space parking <br />garage. San Leandro Crossings also includes a BART parking structure that will replace all of <br />the BART parking (329 spaces) currently provided on Site 1 and will be 339 parking spaces. The <br />property encompasses three parcels totaling approximately 4.22 acres that are currently <br />underutilized (Site 1) and vacant (Site 2). Site 1 has been used as a parking lot for the San <br />Leandro BART Station since 1982. Site 2 encompasses a portion of the former site of the Del <br />Monte Processing Plant. The project site is located within the Downtown San Leandro Transit - <br />Oriented (TOD) Development Strategy Area and is one of the first development projects to <br />implement the TOD Strategy. <br />Copies of the Mitigated Negative Declaration have been sent to the different state agencies for <br />review. A copy of the Mitigated Negative Declaration and Initial Study is attached. The 30 -day <br />public review period established for the document was from March 20, 2009 to April 21, 2009. A <br />copy of the Mitigated Negative Declaration and Initial study has been sent to state agencies for <br />review.
