Page 2 <br />Comment from Lisa Carboni, District Branch Chief, CALTRANS dated April 21, 2009 <br />Comment: The project's fair share contribution, financing, scheduling and <br />implementation responsibilities as well as lead agency monitoring should be fully discussed <br />for all proposed mitigation measures and the project's traffic mitigation fees should be <br />specifically identified in the environmental document. Any required roadway <br />improvements should be completed prior to issuance of project occupancy permits. <br />Response: As evaluated in the Queuing Analysis provided by Kimley-Horn and Associates, the <br />project impacts are less than significant. Therefore, no mitigation is required. <br />Comment: An encroachment permit is required when the project involves work in the <br />State's right of way (ROW). The Department will not issue an encroachment permit until <br />our concerns are adequately addressed. Therefore, we strongly recommend that the lead <br />agency ensure resolution of the Department's California Environmental Quality Act <br />(CEQA) concerns prior to submittal of the encroachment permit application. <br />Response: Comment Noted <br />Comment: On Page 5-8 of the San Leandro Transit -Oriented Development Strategy <br />(SCH#2006052102) Final Environmental Impact Report (EIR), it indicates that, "A <br />project -specific Negative Declaration, Mitigated Negative Declaration or EIR required of <br />individual development proposals, will address specific effects to that level of detail." Upon <br />request (letter dated December 17, 2008), the City provided the Queuing Analysis by <br />Kimley-Horn and Associates, Inc. to the Department which shows impact to the traffic <br />circulation. However, the MND for this proposed project did not address the queuing <br />issue. Please provide the cumulative impacts and mitigation measures to address this <br />queuing issue for our review. <br />Response: The comment submitted by Caltrans refers to the intersection queuing analysis <br />provided in December of 2008. For clarification, this queuing analysis represented an analysis <br />of the San Leandro TOD Strategy's preferred scenario in the Environmental Impact Report <br />(EIR) prepared for the Strategy. The preferred scenario in the TOD Strategy EIR reflected <br />cumulative buildout within the study comprised of 3,200 dwelling units, 690, 000 square feet of <br />
