Minutes - City of San Leandro City Council and Page - 11 - <br />San Leandro Redevelopment Agency Meeting - August 18, 1997 <br />part of the Bay or have anything to do with the San Leandro portion of <br />the Bay. It was also clarified that there will be no new pipeline; this <br />will all go through existing pipeline. The new pipeline will be on the <br />other side of the hill, not our side of the hill. <br />Kai Bender, 261 Begier Avenue, addressed the Council, inquiring as to <br />what influence the Council might have on BART service. He expressed <br />concerns with noise coming from the BART rails. Mr. Bender also <br />expressed concerns with solicitors coming to his door that do not have <br />proper identification. He indicated it is hard to verify the validity <br />of solicitors when it is after office hours at City Hall. He suggested <br />the City issue permits that have the City logo on them. <br />The Mayor responded that the Police Department is involved in the <br />Solicitation Permit process and that they should be able to verify for <br />him if the solicitor has a valid permit to solicit in his neighborhood. <br />Mr. Bender expressed concern that the Police Department response can be <br />slow at times when other pressing matters are being taken care of. <br />Mayor Corbett also noted there is a separately elected BART Board that <br />can be contacted regarding his concerns with noise. She suggested that <br />he contact his representative on that Board directly to have his <br />concerns addressed. <br />Mason Rashid, Chair of the Davis West Neighborhood Group, addressed the <br />Council regarding the continuing noise problems in his neighborhood and <br />stated that, although the City has a noise ordinance, it is too vague <br />and only speaks to noise in general. He encouraged the Council to <br />direct that a new noise ordinance be drafted to address more specific <br />concerns. He also pointed out that there are no enforcement actions <br />provided for in the General Plan or the Municipal Code. He stressed to <br />the Council the need for an enforceable noise ordinance. He provided <br />Council with a sample of a pamphlet from Oakland which describes their <br />Noise Ordinance and enforcement measures. <br />Mayor Corbett explained that staff is in the process of updating the <br />General Plan, and the noise ordinance will be addressed through that <br />process. <br />The City Attorney pointed out, referencing Oakland's Noise Ordinance, <br />that it is a program in and of itself. It was noted that it takes <br />additional funding consideration to have and enforce that type of noise <br />ordinance. He explained the enforcement of "nuisance ordinances" and <br />noted that the Council could, through the new General Plan, proceed with <br />an objective noise ordinance, should they wish to do so. <br />
