And if somebody believes that just a circulation plan <br />is going to address that they are crazy -and you heard it from me. <br />Mayor Corbett: If I could...I think we can ask the City Attorney for his wisdom on <br />how to come up with a solution to this issue of the previous negotiation and where we <br />are now to ensure that we get the mitigation that we are talking about. Because that's <br />the bottom line. <br />City Attorney Meyers: Thank you Mayor. Bob Taylor used a very important phrase <br />when he said it's important for the Council to make a record of its action tonight. If a <br />majority of the Council wishes to authorize its delegate to vote in favor of this agreement <br />and that same majority shares the concerns of Council Member Glaze, relative to the <br />impacts on Lewelling, then it would be wise for you to list out those items that you think <br />are appropriate mitigation measures that should be both addressed in the subsequent EIR <br />and which will be conditions of the encroachment permit to be issued by the City. That <br />way your representative has a basis upon which to inform the rest of the EBDA Board <br />that that's the basis of his vote and that also establishes a track record. So, that when <br />the EIR comes through and the encroachment permit comes through, the staff <br />understands what the Council's concerns are and can start developing, in more detail, <br />those mitigation measures. As to traffic mitigation, Hayward negotiated a general traffic <br />mitigation payment of some $ lOM. That's for all of the traffic associated with growth <br />that will result from the increase in sewage capacity available to the valley.
