City Attorney Meyers: Council Member Glaze, the only way that I can be certain of <br />that is to see what the Council wants in the way of mitigation measures. I can't sit here <br />and guarantee to you that you can approve this contract and then ask for mitigation <br />measures which are beyond the financial scope of the project or totally related to the <br />impacts. I can't do that. <br />Council Member Glaze: O.K. <br />City Attorney Meyers: What I can tell you is that we have two bites of the apple -the <br />encroachment permit and the second EIR. But, that we are going to have some rational <br />relationship -some nexus between those things that we ask for as mitigation and the <br />impacts associated with the construction/reconstruction, trenching of Lewelling <br />Boulevard. Now that can be fairly broad in scope, but, again, I think the Council - I <br />think the Mayor's suggestion is a good one - to have a Council committee set some <br />parameters so that everyone is clear on this. Because, 10 years on this project - we have <br />gone back and forth a number of times. I think it is really important to have a record <br />here. <br />Mayor Corbett: And, we still have some time before Gordon has to take the vote on <br />behalf of the Council, so if we have the opportunity to have the two of you meet, and <br />then everything can be reviewed to address what Steve was just saying, and then we can <br />come back and bring this back to a Council Meeting the beginning of November.
