OK. <br />Council Member Galvan: Can I just make one final point and that is that I think that <br />this is a good idea. The language in the agreement that outlines or refers to separate <br />agreements with member agencies of EBDA is vague for a reason. It says pretty much <br />what it has to say and that is that it acknowledges that there are separate agreements with <br />these member agencies of EBDA. It doesn't detail how many trees or signal lights or <br />this and that -and one of the member agencies of EBDA is threatening to vote against <br />this because of this very issue. So, if we want to go back, load up and change the <br />language in this agreement to be very specific, we are going to jeopardize the agreement <br />moving forward. And the reason for that is Union Sanitary District is opposed to any <br />kind of language in this document referring to other agreements that could expose EBDA <br />legally. The City of Hayward getting $ lOM has nothing to do with EBDA. The City <br />of San Leandro getting all this mitigation for the street has nothing to do with EBDA. <br />So, why are we loading up an agreement between EBDA and LAVWMA with all this <br />language about separate agreements? So, again, my point is we can adopt this tonight <br />and then go back and be very specific in the EIR process and the permit process as to <br />exactly what we want with LAVWMA. <br />October 20, 1997 -Verbatim Transcript, Item 6.A 25 <br />
