Minutes - City of San Leandro City Council Meeting Page - 4 <br />November 24, 1997 <br />C. Linda Perry, Board Member, San Leandro Unified School District, <br />addressed the Council, noting that they intend to work closely with the <br />Council on this important issue. Safety is their primary concern, <br />noting that traffic will impact them tremendously. She said there have <br />been changes recently in the flight paths, due to runway repairs, which <br />have affected the schools. It was noted, again, that the School <br />District passed a resolution in October and forwarded it to the Port of <br />Oakland; but, to date, they have not received any acknowledgment of <br />their action or receipt of the resolution. She concluded by stating the <br />School District fully supports the City's efforts with regard to the <br />mitigation measures. <br />D. Esther Holcomb addressed the Council, suggesting the City pursue a <br />protective walkway over Davis Street. She commented on the truck <br />traffic which will be increased and noted that Davis is not the only <br />street which is in need of protective walkways in order to keep students <br />and children safe. She fully supports what is being requested to be <br />done. <br />E. Tom Himmelberg, Superintendent of Schools, San Leandro Unified School <br />District, addressed the Council, stating he appreciates what the Council <br />has done and that they are asking for the switching of the flight <br />pattern from over the schools. <br />F. Mason Rashid, 705 Tudor Road, addressed the Council and commended them <br />for putting together this resolution. He added that he does have <br />additional concerns. He thanked Kathy Ornelas and Kathy Livermore for <br />doing an outstanding job on this and added he was hoping the Council <br />would take up the inadequacy of the Environmental Impact Report (EIR). <br />He pointed out parts of the EIR he felt contained gross inadequacies. <br />He continued by stating none of the mitigation measures we are <br />requesting would really cost them any money. He concluded by commenting <br />on the harmful pollutants the planes omit. <br />Kathy Livermore interjected that the City did submit comments on air- <br />quality issues. <br />At the request of Council Member Lothrop, the City Attorney clarified that <br />the Port is required to prepare an EIR on its Master Plan Project. The EIR <br />has been prepared in draft form and has been circulated. The comments <br />submitted by all agencies to the Port will go into the administrative <br />record. The Port is required to respond, in detail, to all of the comments <br />that were raised and to give a reasoned and thoughtful response to each of <br />the issues. The final EIR then reflects the comments that were made and the <br />responses to those comments. He noted that, as the Mayor-has pointed out, <br />the final EIR has not yet been published and will not be published until <br />December 5, 1997. At the present time, no one knows for certain whether the <br />Port has taken into consideration all of the comments, some of the comments, <br />none of the comments, the extent to which it has taken those comments into <br />consideration, or what mitigation measures and changes to the project it is <br />proposing in order to alleviate or ameliorate those concerns. But, because <br />of the very short statute of limitations within which any public agency or <br />any citizen has to challenge the conclusions of the report, relative to the <br />
