the issuance of any building permit, will: (a) require the project applicant(s) to notify the FAA; and <br />(b) impose conditions, based on FAA's Notice of Determination, to ensure that the project will not <br />create a hazard that interferes with the navigable airspace, including maintaining the height of any <br />tree, building or structure so that they will not constitute a hazard. <br />10. The Parties agree that following the lottery that the City conducts to implement its <br />Residential Airport Noise Insulation Program pursuant to Section 2 of the 2000 Settlement <br />Agreement, the Parties will review the number of Neptune Drive homeowners registering as <br />interested in participating in the program, and the number of Neptune Drive residential units selected <br />in the City's lottery. Based upon this information, the Port agrees that it will consider paying to the <br />City the cost of insulating more residential units on Neptune Drive than otherwise would be required <br />under the provisions of 2000 Settlement Agreement. The Parties agree that this Section 10 of this <br />Addendum Agreement shall result in binding obligations of the Parties only if they execute, at their <br />discretion, a subsequent mutually-acceptable agreement creating the obligations, and then only to the <br />extent the obligations are expressly provided in the subsequent agreement. The Port further agrees to <br />work with the City in the future to identify any potential funding sources to insulate more homes in <br />the eligible area. <br />11. The Parties agree to work cooperatively with the State Department of Transportation <br />(Caltrans) to modify highway directional signage so that vehicle traffic traveling to or from the <br />Oakland Airport will be directed toward 98~' Avenue wherever possible. <br />12. The Port shall continue the South Field Research Group and will continue to work in <br />good faith with the Cities of San Leandro and Alameda to address the noise issues that result from <br />the South Field operations. <br />Miscellaneous Provisions <br />13.
