shall be discriminated against because of said <br />membership, activity, or support, or lack thereof, or <br />because of the exercising of his/her rights under this <br />Memorandum of Understanding. <br />Section 5. City Rights <br />The rights of the City include, but are not limited to, <br />the exclusive right to determine the mission of its <br />constituent departments, commissions and boards; set <br />standards of service; determine the procedures and <br />standards of selection for employment and promotion; <br />direct its employees; take disciplinary action; relieve <br />its employees from duty because of lack of work or for <br />other legitimate reasons; maintain the efficiency of <br />governmental operations; determine the methods, means and <br />personnel by which government operations are to be <br />conducted; determine the content of job classifications; <br />take all necessary actions to carry out its mission in <br />emergencies; and exercise complete control and discretion <br />over its organization and the technology of performing <br />its work, except as modified by other provisions in this <br />Memorandum of Understanding. <br />Section 6. Pay and Classification <br />6.1 The recognized classifications and those rates of pay <br />which are to be effective during the period of this <br />Memorandum of Understanding are enumerated in Appendix <br />"A" which is attached hereto and made a part hereof. <br />Effective January 1, 2002, salaries shall be increased by <br />five percent (5%) for all unit classifications. This <br />amount is in addition to salary adjustments made in <br />accordance with the implementation of the new <br />compensation plan for the City of San Leandro. <br />Effective January 1, 2003, salaries shall be increased by <br />an amount equal to the change in the San <br />Francisco/Oakland Cost of Living Index for All Urban <br />Consumers for the twelve (12) months ending October, <br />2002. The minimum amount will not be less than three <br />percent (3%) and the maximum amount shall not be more <br />than five percent (5%). <br />Effective January 1, 2004, salaries shall be increased an <br />amount equal to the change in the San Francisco/Oakland <br />Cost of Living Index for All Urban Consumers for the <br />8 <br />
