Hollister <br />City Manager <br />Kathy Ornelas, Community Relations Representative <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />RESOLUTION ADOPTING TITLE 2, CHAPTER 5 OF THE SAN LEANDRO <br />ADMINISTRATIVE CODE RELATED TO AMERICANS WITH DISABILITIES <br />ACT/SECTION 504 OF THE REHABILITATION ACT OF 1973 <br />SUMMARY AND RECOMMENDATION <br />It is recommended that the San Leandro Administrative Code include sections on City staff <br />assigned as City's Coordinators for the Americans with Disabilities Act and Section 504 of the <br />Rehabilitation Act, as well as sections formalizing the City's Reasonable Accommodation Policy <br />and Grievance Policy related to ADA and Section 504. <br />BACKGROUND <br />Section 504 of the Federal Rehabilitation Act was enacted in 1973 and the Americans with <br />Disabilities Act was enacted in 1990, both with the purpose of ensuring and protecting access for <br />people with disabilities to government services, programs and housing. Last year, <br />representatives of the Department of Housing and Urban Development's (HUD) Office of Fair <br />Housing and Equal Opportunity (FHEO) reviewed the City's policies and procedures relating to <br />federally subsidized programs. Overall, the City passed the audit. However, FHEO staff asked <br />the City to agree to formal policies, including the appointment of Coordinators for ADA and <br />Section 504 matters, as well as the City's Reasonable Accommodation Policy and Grievance <br />Policy relating to these federal regulations. <br />Analysis <br />It is recommended that Title 2, Chapter 5 be added to the San Leandro Administrative Code to <br />identify City staff assigned as ADA and Section 504 Coordinators, and to formalize the City's <br />Reasonable Accommodation and Grievance Policies. <br />The Community Relations Representative will be identified as the ADA Coordinator, and the <br />Housing Specialist I will be identified as the Section 504 Coordinator. <br />The City has long maintained a very responsive policy to provide reasonable accommodations to <br />any disabled individual requesting an accommodation. However, this addition to the <br />Administrative Code will formalize that policy.
