Final Subdivision Man, Tract 8010 2 March 1, 2010 <br />is owned by the City. A separate staff report and resolution will be used to approve the sale of <br />the City property to the Chang Income Property Partnership prior to recordation of the Final <br />Map. <br />The low income housing project that is proposed for Lot Two is anticipated to be built by <br />BRIDGE Housing and funded in part by the City. A separate staff report and resolution will be <br />used to approve the City's participation in this portion of the development. <br />The BART parking garage that is proposed for Lot Three, the low income housing project that is <br />proposed for Lot Two, and many of the required improvements and in-lieu fees are anticipated to <br />be funded, in part or whole, by a grant from the State of California. The City, along with the <br />Developer and BRIDGE Housing, is a co-applicant for these grant funds. Separate staff reports <br />and resolutions will be used to approve the City's participation in the grant and specify how the <br />grant funds will be used. In the event that the grant funds are not available for this project, the <br />Developer may wish to rescind this Final Map, the Subdivision Improvement Agreement and the <br />entitlements created by the Vesting Tentative Map. Such action is known as reversion to acreage <br />and may be accomplished by filing a new map per the Subdivision Map Act. The provisions for <br />accomplishing this action are included in the documents related to the City's participation in the <br />grant. <br />The conditions of approval for the Vesting Tentative Map include permission for phasing of the <br />project, which is accomplished by filing multiple final maps. The submitted Final Map for Tract <br />8010 creates Lots One and Two in the configuration shown on the Vesting Tentative Map. The <br />land designated as Lot Three on this Final Map is intended to be re-subdivided by a subsequent <br />final map into Lots Three and Four as shown on the Vesting Tentative Map. <br />The Vesting Tentative Map conferred certain entitlements upon the land. Lots One and Two <br />created by this Final Map will maintain the Developer's entitlements for one year after the Final <br />Map is approved, however the Developer may request that the City approve a one year extension <br />to this time. Development rights vested on Lots Three and Four by the Vesting Tentative Map <br />will expire on March 2, 2016 unless a final map is filed or an extension of the Vesting Tentative <br />Map is obtained. <br />This Final Map creates a public access easement and public sanitary sewer easement across Lot <br />One from Martinez Street to Alvarado Street and also dedicates a strip of land 10-feet wide to the <br />City for use as public right of way along West Estudillo Avenue. Where appropriate, the <br />conditions of approval for the Vesting Tentative Map have been assigned to this Final Map as <br />described in the engineer's report and the Subdivision Improvement Agreement. <br />Analysis <br />The City Engineer's Report, which is attached, contains a listing of the Conditions of Approval <br />for the Vesting Tentative Map. The City Engineer has certified that all of the Conditions of <br />Approval have been satisfied or guaranteed by a Subdivision Improvement Agreement. <br />
