Final Subdivision Map, Tract 8010 3 March 1, 2010 The Conditions of Approval for Vesting Tentative Map 8010 require construction of certain improvements prior to the approval of this map, namely utilities, driveways, and appurtenant work. The Developer has executed a Subdivision Improvement Agreement for the construction of the required improvements. The Agreement includes provisions for deposits, security, and insurance to guarantee the completion of the improvements. Construction of improvements will be secured by a deed restriction recorded in the title record that permits the City to deny issuance of permits for building until either the improvements are complete or a bond for the work has been submitted. The Agreement and security have been reviewed and approved as to form by the City Attorney. The insurance has been reviewed and approved as to form by the City's Risk Manager. The resolution approving the Final Map authorizes the City Manager to execute the Subdivision Improvement Agreement on behalf of the City. Current City Council Policy Title VII, Chapter 1 of the San Leandro Municipal Code and the State Subdivision Map Act regulate the process for approval of final maps. Previous City Council Action(s) On March 2, 2009, by Resolution No. 2009-027, the City Council approved PLN2008-00054 and PLN2008-00031, including the Site Plan review permit and Vesting Tentative Map for Tract 8010 On December 7, 2009, by Resolution No. 2009-161, the City Council amended the conditions of approval for the Vesting Tentative Map to allow phased final maps Applicable General Plan Policy The Final Map complies with the General Plan. Permits and/or Variances Granted Building, grading, and encroachment permits will be required prior to construction of improvements. Environmental Review The. City Council approved a mitigated negative declaration with the Vesting Tentative Map on March 2, 2009. No further environmental review is required. Board/Commission Findings Site Plan Review Permit 2008-00031 was approved by the Planning Commission on January 22, 2009.
