Housing Element Adoption 2010 April 5, 2010 <br />February 2010 Draft also incorporates several changes in response to comments on the June 2009 <br />Draft from the general public. <br />Previous City Council Action <br />The City Council adopted the current Housing Element in January 2003. <br />City Council Committee Review and Action <br />The Council held a number of study sessions on the Element in 2008 and 2009, including a joint <br />study session with the San Leandro Unified School District Board. The Council was last briefed <br />on the Element in Spring 2009. No action was requested at these study sessions and briefings. <br />Applicable General Plan Policy <br />The proposed Housing Element will replace Chapter 9 of the San Leandro General Plan <br />(Housing) in its entirety. <br />Environmental Review <br />A Negative Declaration has been prepared for this update. A "Notice of Public Review and Intent to <br />Adopt a Proposed Negative Declaration" was filed on February 23, 2010. The public review period <br />on the Negative Declaration period extended from February 23, 2010 through March 24, 2010. No <br />comments were received. <br />Board/Commission Findings <br />The Planning Commission reviewed the Element at its March 25, 2010 meeting. Public testimony <br />was received from Congregations Organizing for Renewal (COR) and Urban Habitat. Both <br />organizations spoke in support of the Draft Element, although several modifications were <br />requested. In addition, Planning Commissioner Tom Fitzsimmons requested a number of changes <br />to the Draft Element. These are characterized below: <br />^ Correction of minor typographical errors. These are noted in Appendix A and will be <br />corrected in the Final printed document. <br />^ Recognition of the Rent Review Program and Mission Bay Mobile Home Stabilization <br />Agreement as potential housing constraints. Staff has added text to Chapter 5 of the Draft <br />Element indicating that these programs were evaluated and determined to not be constraints <br />(see Exhibit "A"). <br />^ Use of terms other than "Overpayment" and "Arbitary" on Pages 3-11/3-12 and 6-36, <br />respectively. These are terms of art, used by State HCD and HUD. Staff does not believe it <br />would be appropriate to replace them. <br />^ Inclusion of a zoning map in the Element. Due to the size and scale of the map, it is not <br />feasible to include an 8.5 x 11 version in the Element. However, the on-line version of the <br />Housing Element may include a hyperlink to the Zoning Map. <br />^ Clarification of why the revision to the Condo Conversion Ordinance would require a <br />marketing plan for converted units or set a minimum cost per unit for upgrades.
