WHEREAS, the Planning Commission conducted a duly noticed public hearing on the <br />FEIR and the Project on April 22, 2010, where all interested parties were given the opportunity <br />to participate in the public hearing by submittal of oral and written comments. <br />NOW, therefore, based on the entirety of the before it, which includes without limitation, <br />the California Environmental Quality Act, Public Resources Code § § 21000, et seq. ("CEQA") <br />and the CEQA Guidelines, 14 California Code of Regulations §§ 15000, et seq.; the San Leandro <br />General Plan; the San Leandro Municipal Code; the EIR prepared for the Kaiser Permanente San <br />Leandro Medical Center/Mixed Use Retail Development Project, including all appendices and <br />technical reports thereto; all final applications, including plans, materials, and any other <br />attachments thereto, submitted for the requested approvals for the Project; all reports, minutes, <br />and testimony submitted as part of the Planning Commission's February 18, 2010 hearing on the <br />Project; all reports, minutes, and testimony submitted as part of the Planning Commission's <br />April 22, 2010 hearing on the Project; all matters of common knowledge and all official <br />enactments and acts of the City; and any other evidence (within the meaning of Public Resources <br />Code § 21080(e) and § 21082.2), the Planning Commission of the City of San Leandro does <br />hereby: <br />FIND: That the recitals contained in this Resolution are true and correct and are an <br />integral part of the Planning Commission's recommendations; that all attachments and exhibits <br />to the Staff Report for this Resolution, whether specifically identified in this Resolution or not, <br />are hereby incorporated into this Resolution, as if set forth fully herein; that the custodian of the <br />documents and other materials that constitute the record of the proceedings upon which the <br />Planning Commission's recommendations are based is Luke Sims, Community Development <br />Director, or his designee; that such documents and other materials are located at San Leandro <br />City Hall, 835 East 14th Street, San Leandro, California, 94577; and <br />RESOLVE: That the Planning Commission recommends that the City Council adopt the <br />related CEQA Findings as set forth in EXHIBIT B to the Staff Report ("CEQA Findings") for <br />this Resolution and certify the EIR, and further recommends approval of the Mitigation <br />Monitoring and Reporting Program attached as EXHIBIT D to the Staff Report for this <br />Resolution, prior to taking action on the Project; and <br />FURTHER RESOLVE: That the Planning Commission recommends that the City <br />Council adopt the related Findings for Project Approval as set forth in EXHIBIT C to the Staff <br />Report for this Resolution and amend the General Plan land use designation of the Project site <br />from General Industrial and Light Industrial to General Commercial; and <br />FURTHER RESOLVE: That the Planning Commission recommends that the City <br />Council adopt the related Findings for Project Approval as set forth in EXHIBIT C to the Staff <br />Report for this Resolution and approve re -zoning of the project site from Industrial to <br />Commercial Community with a Planned Development (PD) Overlay; and <br />FURTHER RESOLVE: That the Planning Commission recommends that the City <br />Council adopt the related Findings for Project Approval as set forth in EXHIBIT C to the Staff <br />
