Report for this Resolution and approve the Planned Development Project as being in the public <br />interest and providing superior urban design; and <br />FURTHER RESOLVE: That the Planning Commission recommends that the City <br />Council approve the Development Agreement as being a legally binding agreement, in <br />compliance with the requirements of California Government Code, Sections 65864, et seq. and <br />which provides certainty that development of the Project will promote the orderly planning of <br />public improvements and services, that costs are allocated to achieve maximum utilization of <br />public and private resources in the development process, and that appropriate measures to <br />enhance and protect the environment are achieved; and <br />FURTHER RESOLVE: That this Resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED BY THE FOLLOWING VOTE ON THE 22ND DAY OF APRIL, 2010: <br />AYES- 7 <br />NOES- 0 <br />ABSENT- 0 <br />ABSTENTION- 0 <br />Attest: <br />Name: Kathleen Livermore <br />Secretary to the Planning Commission <br />
