Public Hearing on the Kaiser Medical Center Project <br />pg. 7 <br />May 3, 2010 <br />Monitoring and Reporting Program (Exhibit "D" to the April 22, 2010 Planning Commission <br />Special Hearing), prior to taking action on the Project; <br />3) Adopt the City Resolution adopting the Findings for Project Approval (Exhibit "C" to the <br />April 22, 2010 Planning Commission Special Hearing) and amending the General Plan Land <br />Use designation for the entire 63 -acre project site from General Industrial and Light <br />Industrial to General Commercial; <br />4) Adopt the City Ordinance adopting the Findings for Project Approval (Exhibit "C" to the <br />April 22, 2010 Planning Commission Special Hearing), re -zoning the entire 63 -acres project <br />site from the Industrial General District with a Special Review Overlay District [IG -(S)], to <br />Commercial Community with a Planned Development Overlay [CC -(PD)], and approving <br />the Planned Development Project for Phase 1 of the Medical Center as being in the public <br />interest and providing superior urban design, including approval of the site design concepts, <br />architecture and landscape (see Exhibit "H" to the April 22, 2010 Planning Commission <br />Special Hearing) subject to staff's recommended Conditions of Approval (Exhibit "E" to the <br />April 22, 2010 Planning Commission Special Hearing) <br />5) Adopt the City Ordinance approving the Development Agreement (Exhibit "F" to the April <br />22, 2010 Planning Commission Special Hearing) as being a legally binding agreement in <br />compliance with the California Government Code, Section 65864, et seq, and which provides <br />certainty that development of the Project will promote the orderly planning of public <br />improvements and services, that costs are allocated to achieve maximum utilization of public <br />and private resources in the development process, and that appropriate measures to enhance <br />and protect the environment are achieved. <br />Attachments: <br />Attachment A: April 22, 2010 Planning Commission Staff Report, including the <br />following Exhibits: <br />• Exhibit "A" — Planning Commission Resolution #2010-1 recommending that the City <br />Council approve PLN2009-00030, the Kaiser Permanente San Leandro Medical <br />Center/Mixed-Use Retail Development Project <br />• Exhibit `B" - CEQA Findings and Statement of Overriding Considerations <br />• Exhibit "C" - Findings of Fact for Project Approval — PLN2009-00030 <br />• Exhibit "D" - Mitigation Monitoring and Reporting Program <br />• Exhibit "E" - Staff's Recommended Conditions of Approval <br />• Exhibit "F" - Development Agreement by and between City of San Leandro and <br />Kaiser Foundations Hospitals <br />• Exhibit "G" — Keyser Marston draft Fiscal Impact Assessment <br />• Exhibit "H".- Kaiser's Entitlement Exhibits <br />• Exhibit "J" — Final Environmental Impact Report (not included; available for public <br />review in the City Clerk's Office and on the City website) <br />Attachment B: April 22, 2010 Planning Commission Minutes excerpt <br />
