GRANT OF EASEMENT <br />This GRANT OF EASEMENT (this "Easement") is made and entered into as of the <br />day of May, 2010 by the City of San Leandro, California ("Grantor"), and <br />Livermore Amador Valley Water Management Agency, a joint powers agency, dba LAVWMA, <br />and its respective successors who agree to be bound by the obligations of this agreement <br />(hereinafter collectively called "Grantee") and together referred to as "parties". <br />RECITALS <br />A. Grantor owns that certain real property identified by the Assessor Parcel Numbers <br />080G-0910-002-14 and 080G-1406-031 situated in the City of San Leandro, California, at Bay <br />Trail Lands (the "Property") of the City of San Leandro. <br />B. Grantee desires to obtain a non-exclusive permanent easement for the installation, <br />maintenance, and use of sanitary sewer lines on a portion of the Property under the terms and <br />conditions hereinafter set forth. <br />NOW, THEREFORE, for good and valuable consideration and the mutual promises <br />contained herein, receipt and sufficiency of which is hereby acknowledged, the parties agree as <br />follows: <br />1. Grant of Easement. Grantor hereby grants to Grantee a non-exclusive <br />permanent easement (the "Easement") on a portion of the Property, as more particularly drawn <br />and described in Exhibit A attached hereto and identified thereon as "Sanitary Sewer Easements <br />Over the Lands of the City of San Leandro" (the "Easement Area") and more specifically <br />described on Exhibits B and C, (legal descriptions for said properties) which are incorporated <br />herein by reference In consideration for such grant of Easement, Grantee agrees to pay Grantor <br />the sum of Fifteen Thousand Dollars ($15,000) and comply with all the terms and conditions <br />set forth herein. The use of the Easement granted herein shall be limited to the installation, <br />maintenance, and repair of sanitary sewer pipeline and appurtenances thereto, as more <br />particularly described as follows: <br />(a) Grantor grants to Grantee a non-exclusive permanent easement <br />providing Grantee the right to install, maintain, repair, and replace below grade utility lines and <br />appurtenances thereto and to use the ground surface of the Easement Area for all purposes <br />necessary to install, maintain, repair, and replace in the Easement Area sanitary sewer equipment <br />and appurtenances thereto, specifically below grade utility lines. After such installation, the <br />Grantor may park vehicles on the Easement Area as needed to perform said work. <br />(b) Grantee may install aboveground markers identifying the location of <br />any underground improvements that are installed pursuant to this Easement. The location, type <br />and installation of markers and identifying information on the markers shall be subject to the <br />prior written approval of the City. <br />
