LIABILITY FOR DAMAGES LAVWMA shall be responsible for all liability for personal injury or property damage that may result from work permitted and done by LAVWMA under the permit, or proximately caused by failure on LAVWMA 's part to perform its obligations under said permit in respect to maintenance. If any claim of such liability is made against the City, its officers, or employees, LAVWMA shall defend, indemnify and hold them and each of them, harmless from such claim including any claim based on the active or passive negligence of the City, its officers or employees, insofar as permitted by law. COMPLIANCE WITH APPLICABLE SAFETY LAWS LAVWMA shall comply with all applicable federal, state and local laws and regulations, including Department of Industrial Relations of the State of California (CAL -OSHA) rules and regulations. INSPECTIONS LAVWMA shall allow the City Engineer or his representative the ability to inspect any or all work done pursuant to the permit at reasonable times. NOTIFICATION: COMMENCEMENT OF WORK LAVWMA shall notify the City Engineer at least 48 hours in advance of beginning work. LAVWMA shall also give advance notice to the Police Department and Fire Department of the location and nature of the proposed work. CONSTRUCTION REPRESENTATIVE 1. LAVWMA or its Contractor representative shall be present at the work site whenever work is in progress or whenever actions of the elements necessitate its presence to take measures necessary to protect the work, persons or property. 2.
