EXHIBIT E <br />CONDITIONS UPON TEMPORARY PERMIT TO ENTER AND USE PROPERTY <br />F_OR LIVERMORE AMADOR VALLEY WATER MANAGEMENT AGENCY (LAVWMA) <br />DURING SANITARY SEWER PIPELINE CONSTRUCTION <br />EFFECTIVE THROUGH JANUARY 15, 2012 <br />The City of San Leandro ("City") initiated and agreed to a temporary permit to enter and use property to <br />Livermore Amador Valley Water Management Agency ("LAVWMA" or "Permittee") for the temporary use of <br />portions of parcels owned or managed by the City with APNs 080G-0910-002-14, 080G-0910-002-24, 080G- <br />1406-031, and 080G-1409-138 as depicted on Permit Exhibits A, B, C and D (Legal Descriptions). LAVWMA <br />shall comply with the following requirements and conditions during the use of City property. Failure to <br />comply with all of the requirements will result in the issuance of a "Stop Work Order" and will cause the <br />revocation or suspension of this temporary permit. <br />GENERAL CONDITIONS: <br />1. All catch basins within the work area and the nearest off-site catch basin(s) shall be protected with either <br />straw wattles, hay bales, filter fabric, silt sacks or other BMP method as approved by the City Engineer to <br />prevent silt and debris from entering the on-site and off-site storm drain systems. <br />Water collected from the de-watering operation shall not be discharged into the storm drain system unless <br />Best Management Practices (BMPs) are utilized as required by the San Francisco Bay Regional Water <br />Quality Control Board. <br />3. LAVWMA, or its contractor, shall vacuum and sweep the construction area to eliminate dust from migrating <br />off-site and keep the site cleaal to comply with Federal Clean Water Act. <br />No construction equipment, including contractor's and subcontractor's personal vehicles and/or equipment, <br />shall be parked outside the construction area or within the City right-of--way without the City Engineer's <br />approval. ' <br />5. No contractor or subcontractor shall park their construction equipment, including personal vehicles, entirely <br />or partially in the sidewalk area. Per Section 5610 of the Streets and Highways Code, LAVWMA shall be <br />responsible for the repair of any damaged sidewalk where contractor's or subcontractor's vehicles or <br />equipment are parked irrespective of the previous condition of the sidewalk. <br />6. Construction equipment shall avoid unnecessary idling to reduce COX, ROG, and NOX emissions. <br />Procedures with the highest noise potential shall be scheduled for the times when ambient noise levels are <br />highest (i.e., during peak commute hours). All contractor(s) shall employ the quietest among alternative <br />equipment or muffle/control noise from available equipment. Insofar as possible, noisy operations shall be <br />performed off-site or on portions of the site distant from residential neighborhoods. In addition, the noise <br />levels generated by the construction activities shall not exceed 89 dBA at 50 feet beyond the project <br />boundaries. Construction-related noise shall be limited to the hours of 7:00 a.m. to 6:00 p.m. on weekdays. <br />These hours may be extended with the prior written approval of the City. <br />
