This being the time and place for the Public Hearing on the above
matter, Interim Assistant City Manager John Jermanis presented a
staff report regarding the proposed Business License Fee pertaining
to the sale of firearms. He said he had met with local firearms
dealers to obtain their input; it was determined that Traders,
specifically, would be impacted by the tax. He said that, since
there was no specific anti - violence program identified, the projected
revenue would go into the General Fund.
City Attorney Steve Meyers commented on Proposition 218 and said it
imposes restrictions on local governments to impose new taxes. Taxes
adopted by a City must be approved by the voters in the next General
Election. The next Election will be in the Spring of 1998. He
clarified that, if the Ordinance is adopted, it will become effective
only if the voters concur.
Council Member Galvan asked the number of cities within the Corridor
that had passed this type of Ordinance. Mr. Jermanis noted that
Berkeley had passed a similar Ordinance and Oakland had postponed
action. He said the Oakland staff indicated they were going to
consider San Leandro's direction.
Mayor Corbett noted that, while other cities are looking into the
effect of Proposition 218, the original philosophy has not changed.
Council Member Galvan noted that adoption of an ordinance of this
type has not occurred since the passage of Proposition 218.
