San Leandro. However, the provisions of this Section shall not be applicable to the disposal of <br /> earth, rock, concrete, cement, gravel, sand, plaster, ashes, glass, metal scrap, crockery, cinders, <br /> clay, loam, and other non - combustible inorganic refuse when used for purposes of landfill, if <br /> such material is not otherwise dangerous to health and safety, and such operations do not block <br /> or impede natural drainage channels, drain ditches, canals, or drainage outlets, or result in <br /> pollution, fire hazard or contamination of waters. <br /> ARTICLE 1. GENERAL <br /> Section 3 -7 -100: DEFINITIONS. The following definitions shall govern the construction <br /> of this Chapter unless the context otherwise requires. <br /> (a) GARBAGE. The word "garbage" shall be deemed to include all materials <br /> defined as garbage in title III Chapter 6, Section 3 -6 -100 of this Code. <br /> (b) ITINERANT RUBBISH HAULER. An "itinerant rubbish hauler" is a person <br /> who, for compensation and upon request of the property owner or tenant, removes <br /> lawn and garden rubbish, demolition debris, salvageable or recyclable materials, <br /> or discarded items of furniture, furnishings and clothing on an irregular, <br /> occAsional basis without established routes. For purposes of this Chapter the <br /> persons described in paragraphs (1), (3), (4), (5) and (6) of Section 3 -7 -105 shall <br /> not be deemed to be itinerant rubbish haulers. <br /> (c) PERSONS. "Persons" shall include persons, firms, associations, or corporations. <br /> (d) RUBBISH. The word "rubbish" shall be deemed to include all materials defined <br /> as rubbish in Title III, Chapter 6, Section 3 -6 -210 of this Code. <br /> (e) CITY OR CITY 0 F SAN LEANDRO. "City" or "City of San Leandro" means <br /> the incorporated territory of the City of San Leandro. <br /> Section 3 -7 -105: PROHIBITIONS. <br /> (a) It shall be unlawful for any person to remove rubbish from any place or premises <br /> in the City of San Leandro or convey or transport the same over the public streets <br /> thereof unless: <br /> (1) Such person has a franchise or contract with the City of San Leandro; <br /> (2) Such person is an itinerant rubbish hauler holding a permit issued pursuant <br /> to this Chapter; <br /> (3) Such person is the owner or tenant (or management agent of the owner or <br /> tenant) of the property from which the rubbish was removed; <br /> (4) Such person removes exclusively salvageable or recyclable materials <br /> without compensation; <br /> 8 <br />
