Cameron <br /> February 16, 2000 <br /> Mr. John Jermanis, City Manager <br /> City of San Leandro <br /> 835 E. 10 Street <br /> San Leandro, CA 94577 <br /> SUBJECT: NOVEMBER 1, 1999 ADDENDUM TO "MEMORANDUM OF UNDERSTANDING <br /> BETWEEN THE CITY OF SAN LEANDRO AND <br /> THE ORO LOMA SANITARY RELATED TO THE IMPLEMENTATION <br /> OF RECYCLING PROGRAMS" <br /> Dear John: <br /> Pursuant to our discussions related to the "Memorandum of Understanding Between the City of San Leandro <br /> (hereinafter referred to as "City ") and the Oro Lorna Sanitary District (hereinafter referred to as "District ") Related <br /> to the Implementation of Recycling Programs," this letter will confirm the outcome of those discussions. By this <br /> letter, the City and the District do hereby agree to the following: <br /> I. TERM OF AGREEMENT <br /> The term of the June 9, 1994 Memorandum of Understanding related to the Implementation of Recycling <br /> Programs, is extended for two consecutive periods which will occur automatically: November 1, 1999 thru <br /> October 31, 2004 and November I, 2004 thru August 31, 2007. <br /> 2. OPTION TO EXTEND TERM <br /> The District has incorporated into its March 27, 1997 solid waste collection agreement with its contractor, <br /> an option to extend that agreement up to twenty -four (24) months in periods of at least twelve (12) months <br /> each. The City will notify the District in writing at least twelve (12) months prior to August 31, 2007 if it <br /> does not wish to participate in the District's right to extend its solid waste collection agreement with its <br /> contractor. <br /> 3. MEASURE D FUNDS <br /> The City shall, for the entire term of the two extensions of this Addendum, continue to pay to the District <br /> 40% of all subsequent Measure D funds, and any and all other Recycling Board discretionary monies <br /> received by it from the Recycling Board. Payment of those funds shall be in the same manner set forth in <br /> the June 9, 1994 Memorandum of Understanding <br /> 4. RESIDENTIAL RECYCLING CHARGES <br /> The Oro Loma Sanitary District collects residential recycling charges on the Alameda County Tax Roll. It <br /> is the District's intention that for the duration of its March 27, 1997 solid waste agreement, to not increase <br /> the annual residential recycling charge listed on the tax roll as "AB939 Recycling Charges." <br />
