AGREEMENT TO PROVIDE INFORiMATION <br /> The Oro Loma Sanitary District will for the term of this Agreement and based upon information provided <br /> by its designated collector, provide to the City, waste diversion reports resulting from its recycling programs <br /> in the L-3 area on a quarterly basis. The District will also provide other information made available to it by <br /> its Contractor (such as diversion tonnages) that the City may reasonably request for reporting purposes under <br /> A13939 and Measure D. <br /> 6. COMMERCIAL /INDUSTRIAL RECYCLING PROGRAM <br /> The Oro Loma Sanitary District will for the term of this Agreement assume responsibility and control for <br /> any commercial /industrial components of its recycling program it deems reasonable and prudent to <br /> implement in the L-3 Area. The Program, will at minimum, include those services and efforts as outlined <br /> in the attached Exhibit "13." The City, however, reserves the right to continue its Business Assistance <br /> Program therein, and will if requested by the District, coordinate such efforts with the District so as to avoid <br /> a duplication of efforts and to maximize available resources. <br /> 7. REGULAR MEETINGS <br /> The District and the City agree to meet on a quarterly basis, if needed, to coordinate commercial /industrial <br /> recycling programs in the L-3 Area. The District will put forth its best efforts to assure that its <br /> commercial /industrial recycling program is sufficient to support, and is reasonably consistent with the City's <br /> SRRE. <br /> 8. REVISIONS OR EXPANSIONS TO EXISTING RECYCLING PROGRAMS <br /> At the request of the City and provided the District's contractor is willing to add such service, the District <br /> will implement any new recycling programs that are reasonably feasible. Other than changes mandated by <br /> new regulation, if such revised or expanded programs increase then current customer charges, the District <br /> may advise the customer that said increase and all costs associated with such increase, are being mandated <br /> by the City. <br /> This Addendum, and the June 9, 1994 Memorandum of Understanding constitutes the entire agreement between the <br /> parties with regard to the subject matter hereof and shall supercede all previous negotiations, commitments and <br /> writing with respect to such subject matter. All provisions of the 1994 Memorandum of Understanding not amended <br /> by this Addendum remain in full force and effect. <br /> Michael C.
