Pursuant to the provisions in Section 1777.1 of the Labor Code, the Labor Commissioner publishes and <br /> distributes a list of contractors ineligible to perform work as a subcontractor on a public works project. This <br /> list of debarred contractors is available from the Department of Industrial Relations web site at <br /> http://www. d i r. ca.gov/dir/Labor_l aw /D L S E /De bar. htm I. <br /> The requirement in said Section 2 -3.2 that the Contractor shall perform with its own organization contract <br /> work amounting to not less than 50 percent of the original contract price is not changed by the Federal Aid <br /> requirement in Section 10 of these special provisions that state that the Contractor perform not less than 30 <br /> percent of the original contract work with his own organization. <br /> The DBE information fumished under Section 2- 0.4.2, "DBE Information ", of these special provisions is in <br /> addition to the subcontractor information required to be furnished under said Section 2 -3, "Subcontracts ". <br /> Each subcontract and any lower tier subcontract that may in turn be made shall include the "Required Contract <br /> Provisions Federal -Aid Construction Contracts" in Section 14 of these special provisions. <br /> This requirement shall be enforced as follows: <br /> A. Noncompliance shall be corrected. Payment for subcontracted work involved will be withheld from progress <br /> payments due, or to become due, until correction is made. Failure to comply may result in termination of the <br /> contract. <br /> Delete the remainder of this section if no DBE goals are specified. <br /> In conformance with the Federal DBE regulations Sections 26.53(0(1) and 26.53(0(2) Part 26. Title 49 CFR: <br /> A. The Contractor shall not terminate for convenience a DBE subcontractor listed in response to Section 2- 1.028, <br /> "Submission of DBE Information," and then perform that work with its own forces. or those of an affiliate <br /> without the written consent of the Department, and <br /> B. If a DBE subcontractor is terminated or fails to complete its work for any reason, the Contractor will be required <br /> to make good faith efforts to substitute another DBE subcontractor for the original DBE subcontractor, to the <br /> extent needed to meet the contract goal. <br /> Rev. 8-00 Page 65 Special Provisions — Section 2 <br /> Project No. <br />
