2 -3.5 DBE CERTIFICATION STATUS If a DBE subcontractor is decertified during the life of the project, <br /> the decertified subcontractor shall notify the Contractor in writing with the date of decertification. If a <br /> subcontractor becomes a certified DBE during the life of the project, the subcontractor shall notify the <br /> Contractor in writing with the date of certification. The Contractor shall furnish the written documentation to <br /> the Engineer. <br /> Upon completion of the contract. Form CEM -2403 (F) indicating the DBE's existing certification status shall <br /> be signed and certified correct by the Contractor. The certified form shall be furnished to the Engineer within <br /> 90 days from the date of contract acceptance. <br /> Required for ALL construction contracts administered under the Caltrans Standard <br /> Specifications, dated July, 1999. However this should be deleted if no DBE goals are specified. <br /> 2 -3.6 PERFORMANCE OF DBE SUBCONTRACTORS AND SUPPLIERS The DBE's listed by the <br /> Contractor in response to the requirements in the section of these special provisions entitled "Submission of <br /> DBE Information, Award, And Execution Of Contract ", which are determined by the Department to be <br /> certified DBE's. shall perform the work and supply the materials for which they are listed unless the <br /> Contractor has received prior written authorization to perform the work with other forces or to obtain the <br /> materials from other sources. <br /> Authorization to utilize other forces or sources of materials may be requested for the following reasons: <br /> 1. The listed 013E. after having had a reasonable opportunity to do so, fails or refuses to execute a written <br /> contract, when such written contract, based upon the general terns, conditions, plans and specifications <br /> for the project. or on the terms of such subcontractor's or supplier's written bid. is presented by the <br /> Contractor. <br /> 2. The listed DBE becomes bankrupt or insolvent. <br /> 3. The listed DBE fails or refuses to perform his subcontract or furnish the listed materials. <br /> 4. The listed DBE subcontractor fails or refuses to meet the bond requirements of the Contractor. <br /> 5. The work performed by the listed subcontractor is substantially unsatisfactory and is not in substantial <br /> accordance with the plans and specifications, or the subcontractor is substantially delaying or disrupting <br /> the progress of the work. <br /> 6. It would be in the best interest of the City. <br /> The Contractor shall not be entitled to any payment for such work or material unless it is performed or <br /> supplied by the listed DBE or by other forces (including those of the Contractor) pursuant to prior written <br /> authorization of the Engineer. <br /> 2 -3.7 SUBCONTRACTING Attention is directed to the provisions in Section 2 -3. "Subcontracts ", of the <br /> Standard Specifications. Section 2 -0.1. "Disadvantaged Business ". Section 2 -0.2, "DBE Goal for the Project ", <br /> Section 2 -0.4.
