SECTION X <br /> VOTING PROCEDURE <br /> VOTING PROCEDURE <br /> Actions of the Council shall be taken by ordinance, resolution or motion. Actions of the <br /> Council shall require the affirmative votes of a majority of the entire Council <br /> membership. The Council shall pass ordinances and resolutions only by taking the ayes <br /> and nays by an open vote, which shall be entered in the minutes of the meeting. The ayes <br /> and nays shall be taken and recorded on all motions. Abstentions shall also be recorded. <br /> (San Leandro Municipal Code, Title 1, Chapter I, Article 3) <br /> TIE VOTES <br /> Tie votes shall be lost motions. When all Council Members are present, a tie vote <br /> whether to grant an appeal from official action shall be considered a denial of such <br /> appeal, unless the Council takes another action to further consider the matter. If a tie vote <br /> results at a time when less than all members of the Council are present, the matter shall <br /> automatically be continued to the agenda of the next regular meeting of the Council, <br /> unless otherwise ordered by Council. (Official actions are those quasi judicial actions <br /> such as made by the Planning Commission wherein less than four votes sustains their <br /> action.) <br /> ABSTENTIONS <br /> Abstentions shall be counted, but shall not be recorded as either an "aye" or "nay" vote. <br /> Should a Council Member abstain from voting on an issue due to a conflict of interest, an <br /> announcement should be made prior to the discussion of the item indicating the reason <br /> for the abstention. <br /> X- <br />
