IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2010 -155 <br /> RESOLUTION ACCEPTING THE WORK FOR AMERICANS WITH DISABILITIES ACT <br /> (ADA) RAMP PROJECT 09 -10, PROJECT NO. 09-165-43-216 <br /> Pursuant to a contract between the City and Spencon Construction, Inc. dated September <br /> 21, 2009 by Resolution No. 2009 -132, Spencon Construction, Inc. has completed the Americans <br /> with Disabilities Act (ADA) Ramp Project 09 -10, Project No. 09- 165 -43 -216. <br /> Said work has been completed in accordance with the plans and specifications and to the <br /> satisfaction of the Engineering and Transportation Director. who therefore recommends that said <br /> work be accepted. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That the work hereinbefore described is hereby accepted. <br /> 2. That the City Clerk is hereby directed to file a Notice of Completion on said <br /> project. <br /> 3. That the bonds heretofore given for performance and payment of said conditions <br /> are hereby discharged and exonerated from further liability. <br /> 4. That upon completion of the one -year Maintenance Period established pursuant to <br /> said contract, and to the satisfaction of the Engineering and Transportation <br /> Director, the City Manager is hereby authorized to release the bond heretofore <br /> given for maintenance of the work hereinbefore described. <br /> Introduced by Councilmember Prola and passed and adopted this 20th day of December, <br /> 2010, by the following called vote: <br /> Members of the Council: <br /> AYES: Councilmembers Gregory, Prola, Reed, Souza, Starosciak, Stephens; <br /> Mayor Santos (7) <br /> NOES: None (0) <br /> ABSENT: None (0) <br /> ATTEST: 44 j4 JAM !G,L!
