Red Light Photo Enforcement Program 2 April 18, 2011 <br /> Current City Council Policy <br /> Not applicable. <br /> Previous City Council Action(s) <br /> • On September 6, 2005, by Resolution No. 2005 -127, the City Council approved a five (5)- <br /> year agreement with Redflex Traffic Systems, Inc. to provide a Red Light Photo <br /> Enforcement Program. <br /> • On April 4, 2011, by Minute Order No. 2011 -066, the City Council authorized the City <br /> Manager to execute an agreement extension with directions to negotiate for more favorable <br /> terms and bring an agreement back to the City Council for consideration. <br /> Fiscal Impact <br /> The equipment used for the Red Light Camera System is on a lease basis from the vendor, <br /> Redflex Traffic Systems, Inc. The monthly leasing fee per approach was $5,800 during the <br /> duration of the expired contract. The negotiated fee for the new contract is $5,200 monthly per <br /> approach, and the number of approaches has been reduced to five (5). It was determined that <br /> there was no longer a need for a red light camera at the approach at Lewelling <br /> Boulevard/Washington Avenue due to the drastically reduced number of violations since the <br /> deployment of the camera, and the lack of fines generated to cover the monthly leasing cost. <br /> The new contract will have a long term construction clause that gives the City protection should <br /> a red light camera intersection be under construction for an extended period of time, not allowing <br /> photo enforcement to take place. The clause has the City continue to pay for the intersection for <br /> the first 7 days of construction; the terms of the contract for that approach will then be suspended <br /> until the construction is completed. <br /> The contract proposal also contains clauses that would suspend the contract should legal issues <br /> arise that do not allow us to enforce red light camera violations. These issues are covered at both <br /> the State Supreme Court and Alameda County Superior Court levels. <br /> The new contract contains a CPI Cap of 2% per year. Projecting out the maximum 2% increase <br /> per year during the life of the contract would have the following results: <br /> • 2011 - $5,200 per month / per approach <br /> • 2012 - $5,304 per month / per approach <br /> • 2013 - $5,410.08 per month / per approach <br /> • 2014 - $5,518.28 per month / per approach <br /> • 2015 - $5,628.65 per month / per approach <br /> • 2016 - $5,741.22 per month / per approach <br /> • 2017 - $5,856.04 per month / per approach <br /> • 2018 - $5,973.17 per month / per approach <br /> Budget Authority <br /> Red Light Camera General Fund Account - 010 -21- 021 -5610 <br /> ' <br /> Tracy Vesely,''Finance Di ctor <br />
