Fairway Dr. Right of Way Vacation 2 May 2, 2011 <br /> leased by Simmons Mattress Company). There are extensive improvements to be constructed for <br /> the hospital construction along both the Fairway Drive and Merced Street frontages. <br /> The Kaiser parcel is under development for a hospital with medical offices to service the area. <br /> The portion of the Fairway Drive frontage road that abuts the Kaiser property will be widened <br /> and improved with a standard sidewalk. Due to a difference in grades between the roadway and <br /> the site, a retaining wall of less than 2 feet will be built behind the sidewalk. The proposed street <br /> vacation will keep the right -of -way parallel to the new improvements and allow the retaining <br /> wall to be built entirely on private property. The area to be vacated is located approximately 107 <br /> feet east of the Miller Street intersection, on the north side of Fairway Drive underneath the <br /> Fairway Drive Overcrossing. The area to be vacated is located behind the existing sidewalk, <br /> contains no roadway improvements, and contains no utilities. The area is excess right -of -way of <br /> Fairway Drive and is not required for street purposes and as noted there are no utility facilities <br /> that are in use that would be affected by the vacation. <br /> Letters were sent out in March 2011 to inform EBMUD, PG &E, AT &T, and Comcast of the <br /> proposed vacation to allow them to provide objections. None of the utility companies expressed <br /> any opposition to the vacation of this portion of the public right -of -way. <br /> Environmental Review <br /> This summary vacation of right -of -way is Categorically Exempt per California Code of <br /> Regulations Section 15061(b)(3). <br /> Fiscal Impact <br /> All of the costs for processing the summary vacation will be paid by the developer. <br /> Attachments <br /> Vicinity Map <br /> CONCLUSION <br /> Staff recommends adoption of a resolution summarily vacating a portion of the public right -of- <br /> way on Fairway Drive (at 2500 Merced Street). <br /> G: \_Council Items In Process\MAY 02\Fairway Drive - VAC ROW\I airway Dr - VAC ROW MEM.Doca <br />
