"Owner" means each person or entity holding a record ownership interest in a <br /> Condominium, including Declarant. "Owner" shall not include any person or entity who <br /> holds an interest in a Condominium merely as security for the performance of an <br /> obligation. <br /> "Percentage Interest" means the percentage of undivided leasehold interest in all or a <br /> portion of the Common Areas pursuant to the provisions of Section 2.3 of this <br /> Declaration. <br /> 'Person" means a natural person. corporation, partnership, association. trust, or other <br /> entity capable of holding title to real property, or any combination thereof. <br /> "Project" means the Land and all improvements on the La d,collectively known as <br /> Wisteria. <br /> "Rules and Regulations" means those rules and regulations adopted by the Association <br /> or its Board, including any amendments thereto goving the use and occupancy of the <br /> Project. \/ <br /> "Single Family" means one or more person�,each related to the, the by blood, marriage <br /> or adoption, or a group of not more than six (9•persons, not so related, together with his, <br /> hers. or their domestic servants, maintaining a household. <br /> "Unit' means a separate estate in space as defined in California Civil Code <br /> 1351(1) and as described in Section 3.1 of this Decla�ation.,A Unit consists ofall those <br /> component elements bearing the Numbe designation in the <br /> Condominium Plan. The Identifying` Lumber designation'of a component element <br /> coincides with the number of that Unit�of which it is a part. Whenever reference is made <br /> to any of the Units. it shall be construed that reference is made to the Unit as a whole and <br /> to each and all of its component elementi\The Units and their respective boundaries are <br /> further described'in-Sectio \3.l'of this Declara {on, to the Condominium Plan, and in <br /> deeds conveying Condominiumslexcept that in -interpreting deeds and plans, the existing <br /> physical boundaries of a Unit or of a Unit reconstructed in substantial accordance with <br /> the original-plan shall be condlusivel'- presumedto be its boundaries. rather than the <br /> description -exp se sed in the deed or Condbmin um) Plan, regardless of minor variance <br /> between boundaries shown on the Condomin ui m Plan, or in the deed and those of the <br /> building and regardless of settling o lateral movement of the building. <br /> \Exhibits. All exhibits to this Declaration and all attachments thereto are <br /> hereby incorporated by reference in this Declaration. <br /> • 1.3 Interpretation of Declaration. The terms. covenants. conditions. and <br /> restrictions set forth in this'Declaration, the Bylaws, and the Articles are intended to be <br /> construed to be consistent with the terms, covenants, conditions, and restrictions set forth <br /> in the Common Areas Lease. In the event of any conflict in interpretation, the terms, <br /> covenants, conditions and restrictions contained in the Common Areas Lease shall <br /> control. <br /> ARTICLE 2 ESTABLISHMENT OF THE CONDOMINIUM <br /> 2.1 Submission of Property and Division into Estates. <br />
