Sanitary Sewer Connection Fee 2 September 6, 2011 <br />evaluate the incremental cost of wastewater collection and treatment facilities to accommodate <br />the projected growth. <br />Analysis <br />A TOD Infrastructure Study completed in 2010 identifies specific construction projects that <br />should be undertaken to increase the system capacity to the level required to serve the increased <br />density now permitted in the downtown area. The TOD Infrastructure Study was funded in part <br />by a grant from the Metropolitan Transportation Commission (MTC); our agreement with MTC <br />requires that a resolution be passed affirming that our new connection fees adequately <br />compensate the City for the impacts of the new density permitted in the downtown area. <br />A Wastewater Capacity Charge Study (WCCS) completed in 2010 includes a comprehensive <br />evaluation of the value of the existing collection and treatment system, the quantity of <br />wastewater that can be treated, and the cost to provide collection and treatment facilities for each <br />user (the connection fee). The connection fees calculated in the WCCS include consideration of <br />the projects identified in the TOD Infrastructure Study. The WCCS concludes that our previous <br />sanitary sewer connection fees, that were originally based on the 1997 WCCS, are not adequate <br />to cover the cost of constructing additions to the collection and treatment system and <br />recommends new fees that are 1'/2 to 2 times higher than previously charged. The sanitary sewer <br />connection fee was raised to the recommended level for the 2010 -11 fiscal year and should be <br />modified each year to keep pace with the cost of construction. <br />In order to provide for the yearly adjustment of the connection fee the San Leandro <br />Administrative Code Title 12, Chapter 5 Section 115 will be amended to add the following: <br />(i) The Sanitary Sewer Connection Fee shall be modified each July I by an amount equal to <br />either the amount shown in the Wastewater Capacity Charge Study (2010) or the <br />percentage change in the Consumer Price Index (CPI) for the San Francisco Bay Area as <br />published by United States Dept of Labor Bureau of Labor Statistics from the preceding <br />one year period, whichever is greater. <br />The collected connection fees will be used to fund projects that increase the capacity of the <br />sanitary sewer collection and treatment system to the level required by our current Zoning Code, <br />including those projects identified in the TOD Infrastructure Study. <br />Previous City Council Action(s) <br />• On June 21, 2010, by Resolution No. 2010 -070, City Council approved a resolution <br />adopting Wastewater Discharge Rates as Published in the Notice of Proposed Sewer and <br />Wastewater Treatment Rates for Fiscal Years 2010 -11 Through 2014 -15 <br />• On June 15, 2009, by Resolution No. 2009 -091, City Council approved a contractual <br />services agreement with Carollo Engineers to provide the TOD Infrastructure Study <br />
