IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011 -180 <br /> RESOLUTION ACCEPTING THE WORK FOR THE ANNUAL SIDEWALK PROGRAM <br /> 2010-11, PROJECT NO. 10- 144 -36 -006 <br /> WHEREAS, pursuant to a construction contract between the City of San Leandro and <br /> AJW Construction, approved on July 19, 2010 by Resolution No. 2010 -087, AJW Construction <br /> has completed the Annual Sidewalk Program 2010 -11, Project No. 10- 144 -36 -006; and <br /> WHEREAS, said work has been completed in accordance with the plans and <br /> specifications and to the satisfaction of the Engineering and Transportation Director, who <br /> therefore recommends that said work be accepted. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That the work hereinbefore described is hereby accepted; and <br /> 2. That the City Clerk is hereby directed to file a Notice of Completion on said project; <br /> and <br /> 3. That the bonds heretofore given for performance and payment of said conditions are <br /> hereby discharged and exonerated from further liability; and <br /> 4. That upon completion of the one -year maintenance period established pursuant to <br /> said contract, and to the satisfaction of the Engineering and Transportation Director, the City <br /> Manager is hereby authorized to release the bond heretofore given for maintenance of the work <br /> hereinbefore described. <br /> Introduced by Councilmember Reed and passed and adopted this 17th day of October, <br /> 2011, by the following vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Gregory, Prola, Reed, Souza, Starosciak; <br /> Mayor Cassidy (7) <br /> NOES: None (0) <br /> ABSENT: None (0) <br /> ATTEST: V V -RAC I/l,l_. 4/611/ <br /> Marian Handa, City Clerk <br />
