• <br /> ® • <br /> SECTION 6. OVERTIME (Contd.) <br /> B. OVERTIME WORK DEFINED. <br /> 1. Non -FLSA (MOU) Overtime - Overtime work shall be defined as all work <br /> performed pursuant to Section 6.A. in excess of the normal tours of duty and <br /> fire schedules set forth in Section 5. Paid time off shall count toward the <br /> accumulation of the normal work schedule as it applies to this section. <br /> 2. FLSA Overtime Work Defined - FLSA overtime work shall be defined as all <br /> work performed pursuant to Section 6.A. in excess of the normal work period <br /> set forth in Section 6.B.2.a. (including paid leave and holidays). Overtime shall - <br /> be compensated at one and one -half (1 -1/2) times the FLSA regular rate as <br /> defined in Section 6.c. either in cash or compensatory time, at the discretion <br /> • of the Fire Chief. <br /> a. Fire Suppression Work Periods <br /> For employees working an average of 56 hours per week, overtime shall <br /> include all time worked in excess of the actual hours worked in a work <br /> • period (including paid leave and holidays) as follows: <br /> Work Period: 27 days <br /> Actual hours worked: 204 hours <br /> b. Work Period for other than Fire Suppression <br /> Overtime shall include all time worked in excess of the actual hours <br /> worked in the 40 hour work period (including paid leave and holidays) <br /> as follows: <br /> Work Period: 7 days <br /> Actual hours worked: 40 hours <br /> C. RATES DEFINED. <br /> • <br /> 1. For employees working a 40 hour workweek, the hourly rate shall be the • <br /> monthly base salary multiplied by 12 and divided by 2,080. <br /> For employees working an average 56 hour workweek, the hourly rate shall be <br /> the monthly base salary multiplied by 12 and divided by 2912. <br /> 2. An employee's FLSA regular rate shall include in addition to his hourly rate <br /> as defined in C -1, any applicable premium payment pursuant to Sections 12.D. <br /> and 12.E., Sections 16 and 17 of this Memorandum. <br /> D. OPPORTUNITY FOR OVERTIME WORK. When practical in the determination <br /> of the Chief, employees shall be given the opportunity to be called back for overtime <br /> work on an equitable within rank basis. Records shall be maintained for the periods <br /> of January 1 through December 31, and overtime work posted on Station bulletin <br /> boards. If any inequality arises, every effort shall be made in the next 6 -month period <br /> to achieve equality. If at the end of the second 6 -month period, an employee who, <br /> desiring to work overtime, was not afforded the opportunity to do so within the <br /> 171 <br /> FIRE - 5 • <br />
