• <br /> Appendix C <br /> Page 12 <br /> of positions by which each class shall be reduced, the date the reduction is to take effect and <br /> shall notify the Commission of these determinations. When specific positions within a class <br /> require special skills, knowledge, or abilities, the department head, with prior concurrence <br /> of the Commission, my designate specialties within a class and treat such approved specialty - <br /> as a separate classification for purpose of lay -off and demotion in lieu of lay -off - <br /> 2008 Order of Lav -off <br /> When a reduction in force becomes necessary, the Commission shall provide lay -off <br /> instructions to affected departments detailing the lay -off procedures and policies to be used <br /> by departments in determining the order of lay -off for affected employees. Any appeals <br /> concerning departmental actions under the instructions of the Commission shall be governed <br /> by the Commission's Administrative Appeals Rules. Lay -off shall be accomplished in inverse <br /> order of total County service, except as may be provided in Rule 2014 and as may be provided <br /> by applicable Federal or State regulations. For purposes of this rule, Total County Service <br /> shall be defined as the sum total of paid service for the County without regard to whether such <br /> service was continuous, full-time, less than full -time, tenured, probationary, provisional, <br /> temporary or emergency. All ties in service time will be resolved according to criteria <br /> • <br /> established by the Commission. <br /> • <br /> • Before any tenured employee is Laid off, all appointees working in affected classes under <br /> emergency, provisional, temporary or probationary appointments shall be separated in the <br /> above sequence, except that the provisions of this sentence shall not apply to probational <br /> appointees reinstated pursuant to Rule Number 1744 and to employees on probation by virtue <br /> of job reclassification where such employee was continuously performing the same job <br /> functions six (6) months prior to the reclassification. <br /> Any employee subject to lay -off as a result of being in a promotional probationary status <br /> . in a new department may at the decision of the Commission be allowed to demote in lieu of <br /> lay -off to the employee's former classification and department. Any employee so affected shall • <br /> • request a Commission determination within ten (10) working days' of notification of the lay -off <br /> status. <br /> 2010 Lateral Movement/Displacement in Lieu of Lav -Off <br /> An employee in a classification affected by a reduction in force may, •in lieu of lay -off, <br /> elect to move to a position in an equal - paying classification (in the same department) where <br /> vacancies exist, provided that such employee has held tenure in that equal - paying <br /> classification. In a situation where there are no vacant positions, an employee who has held <br /> tenure in an equal - paying classification may displace another employee in an equal - paying <br /> classification within the same department, provided that such displacement in the equal- <br /> . <br /> paying classification is effected pursuant to Rule 2008. The employee who has held tenure in <br /> more than one equal- paying classification does not have an option as to the class in which the <br /> displacement will occur, but will be permitted to move only into the class then filled by the <br /> • <br /> employee with the least amount of total County Service. <br /> - 207 <br /> FIRE -41 <br />
