For purposes of lay -off or demotion in lieu of lay -off, flexibly <br /> staffed classifications, as defined in the annual salary ordinance, may, with the concurrence <br /> of the Commission be treated as one classification. Except as provided in Rule 2014, when <br /> both the employee demoting and the employee in the lower paying class have. equal Total <br /> County Service, the employee in the lower paying classification would be Laid off or demoted <br /> first. Reduction in force or demotion in lieu of lay -off in one agency /department shall not affect <br /> employees in another agency /department except as provided in Rule 2008. <br /> Employees . exercising their right of demotion in lieu of lay -off must demote to lower <br /> paying classifications, in order of the pay levels of the classification. <br /> 2014 Demotion in Lieu of Lav -Off for Swonn Classes in the Sheriffs Department <br /> An employee in a Sheriffs Department sworn classification affected by a reduction in <br /> force may, in lieu of layoff, elect to demote to a lower paying Sheriffs Department sworn <br /> classification, provided that such employee has held tenure in the lower paying classification. <br /> For purposes of layoff or demotion in lieu of layoff, flexibly- staffed classifications, as defined <br /> in the annual Salary Ordinance, may, with the concurrence of the Commission be treated as <br /> one classification. Resultant demotions or layoffs shall be accomplished in inverse order of <br /> total paid service in a Sheriffs Department sworn classification. For purposes of this Rule <br /> 2014, total paid service in a Sheriffs Department sworn classification shall include all paid <br /> service worked in a classification plus paid service worked in any higher level Sheriffs <br /> Department sworn classificationts). When both the employee demoting and the employee in <br /> the lower paying classification have equal total paid service in a Sheriffs sworn classification, <br /> the employee in the lower paying classification would be laid off or demoted first. Reduction <br /> in force or demotion in lieu of layoff in one Agency shall not affect employees in <br /> another Agency/Department except as provided in Rule 2008. <br /> 2016 Re- Employment <br /> Employees with tenure in the class and department from which they were laid off, <br /> including employees who elected to take a demotion in lieu of lay -off, shall have re- <br /> employment rights to future vacancies in such class and department. The names of laid off • <br /> and demoted employee_ shall be placed, in the inverse order of lay -off, on the departmental <br /> preferred list established for the class.
