• • ,,� � � � ram <br /> Appendix C D , J <br /> Page 13 <br /> 2008 Order of Lav -off <br /> When a reduction in force becomes necessary, the Commission shall provide lay -off instructions <br /> to affected departments detailing the lay -off procedures and policies to be used by departments <br /> in determining the order of lay -off for affected employees. Any appeals concerning departmental <br /> actions under the instructions of the Commission shall be governed by the Commission's <br /> Administrative Appeals Rules. Lay -off shall be accomplished in inverse order of total .County <br /> service, except as may be provided in Rule 2014 and as may be provided by applicable Federal <br /> or State regulations. For purposes of this rule, Total County Service shall be defined as the sum <br /> total of paid service for the County without regard to whether such service was continuous, full - <br /> time, less than full-time, tenured, probationary, provisional, temporary or emergency. All ties in <br /> service time will be resolved according to criteria established by the Commission. <br /> Before any tenured employee is laid off, all appointees working in affected classes under <br /> emergency, provisional, temporary or probationary appointments shall be separated in the above <br /> sequence, except that the provisions of this sentence shall not apply to probational appointees <br /> reinstated pursuant to Rule Number 1744 and to employees on probation by virtue of job <br /> reclassification where such employee was continuously performing the same job functions six (6) <br /> months prior to the reclassification. <br /> Any employee subject to lay -off as a result of being in a promotional probationary status in a new <br /> department may at the decision of the Commission be allowed to demote in lieu of lay -off to the <br /> employee's former classification and department. Any employee so affected shall request a <br /> Commission determination within ten (10) working days of notification of the lay -off status. <br /> 2010 Lateral Movement/Displacement in Lieu of Lav -Off <br /> An employee in a classification affected by a reduction in force may, in lieu of lay -off, elect to <br /> move to a position in an equal- paying classification (in the same department) where vacancies <br /> exist, provided that such employee has held tenure in that equal- paying classification. In a <br /> situation where there are no vacant positions, an employee who has held tenure in an equal - <br /> paying classification may displace another employee in an equal - paying classification within the <br /> same department, provided that such displacement in the equal- paying classification is effected <br /> pursuant to Rule 2008. The employee who has held tenure in more than one equal- paying • <br /> classification does not have an option as to the class in which the displacement will occur, but will <br /> be permitted to move only into the class then filled by the employee with the least amount of total <br /> County Service. <br /> Reduction in force, or displacement in lieu of lay -off in one agency /department shall not affect <br /> employees in other agencies/departments except as provided for in Rule 2008, and any <br /> movement/displacement under this rule shall be in accordance with the provisions of Rule 2008. <br /> IAFF Local 1428 - Management Unit R34 <br /> January 1, 1994- December 31, 1995 <br /> 36 <br /> 3 0 4 Local 1428- M1D11.2 <br /> RUdm- 6f15/96 <br /> • <br />
