EXHIBIT E <br /> GENERAL CONDITIONS <br /> 1. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may <br /> be funded by fiscal assistance from another governmental entity, Recipient shall <br /> comply with all applicable rules and regulations to which City is bound by the terms <br /> of such fiscal assistance program. In particular, Recipient agrees to comply with all <br /> applicable provisions of the Housing and Community Development Act of 1974 <br /> (Public Law 93-383) and regulations promulgated pursuant thereto. <br /> 2. RECORDS. Records must be kept accurate and up-to-date. Recipient's records <br /> shall be made available for review by the City, HUD or the designee. Recipient shall <br /> be responsible to maintain, for not less than three (3) years after completion of this <br /> Agreement, all records pertaining to this Agreement, including subcontracts and <br /> expenditures, and all other financial and property records. <br /> 3. AUDITS AND INSPECTIONS. <br /> A. Recipient shall at any time during normal business hours and as often as <br /> the City, HUD and the Comptroller General of the United States may deem <br /> necessary, make available to their representatives for examination all of Recipient's <br /> records with respect to all matters covered by this Agreement and shall permit these <br /> representatives to audit, examine and make excerpts or transcripts from such records, <br /> and to make audits of all documents and conditions relating to this Agreement. All <br /> costs are subject to the eligibility requirements of HUD. <br /> B. Recipient shall permit and facilitate observation and inspection of the <br /> work and records at Recipient's principal office and job site by City, its employees <br /> and public authorities during reasonable business hours. <br /> 4. CONFLICT OF INTEREST. <br /> A. Recipient certifies that no member of, or delegate to the Congress of the <br /> United States shall be permitted to share, or take part in this Agreement or in any <br /> benefit arising therefrom. <br /> B. Recipient certifies that no member, officer, or employee of the City of <br /> San Leandro, or its designees or agents, no member of the San Leandro City Council, <br /> 1 <br />
