Lead-Based Paint <br /> Recipient agrees that all rehabilitation or construction of residential <br /> structures with assistance provided under this contract shall be subject to HUD Lead- <br /> Based Paint Regulations at 24 CFR 570.608, and 24 CFR Part 35, and in particular <br /> Sub-Part B thereof. Such regulations pertain to all HUD-assisted housing and require <br /> that all owners, prospective owners, and tenants of buildings constructed prior to <br /> 1978 be properly notified that such properties may include lead-based paint. Such <br /> notification shall point out the hazards of lead-based paint and explain the <br /> symptoms, treatment and precautions that should be taken when dealing with lead- <br /> based paint poisoning. <br /> 13. RELOCATION/ANTI-DISPLACEMENT. Recipient shall comply with all <br /> relocation and displacement regulations and procedures applicable to all HUD <br /> assisted programs. Such regulations and procedures are contained in 24 CFR Part 42 <br /> and 24 570.606; Sections 104(d), 104(k), 105(a)(11) of Housing and Community <br /> Development Act; and 42 USC 4601. <br /> 14. IMPROVEMENTS TO CHURCH OWNED PROPERTY. Recipients who use <br /> CDBG funds for improvements to church owned property shall enter into an <br /> agreement with the church to provide for the reimbursement of the remaining value <br /> of improvements upon cessation of use of the property for public service. The <br /> Agreement shall require Church to repay the Recipient, or City if the Recipient ceases <br /> to exist, an amount not less than the value of the remaining useful life of <br /> improvements. Recipient shall remit the funds to the City. <br /> Such agreement between Recipient and Church shall follow the requirements set <br /> forth in 24 CFR 570.200. City will assist in determining the depreciating value of <br /> the improvements. <br /> 15. SECTION 504 - PROGRAM ACCESSIBILITY <br /> A. General Prohibition Against Discrimination <br /> No qualified individual with a handicap shall, solely on the basis of handicap, <br /> be excluded from participation in, be denied the benefits of, or otherwise be subjected <br /> to discrimination by a Recipient receiving Federal assistance as part of the CDBG <br /> program. <br /> 9 <br />
